Your Rights as a Pedestrian in Reno
The State of Nevada has certain laws and statutes regarding pedestrian activity. If you decide to walk or jog around Reno, it is your responsibility to understand and obey these laws. This can keep your movements predictable to surrounding drivers and reduce your risk of getting hit by a car. You also have certain rights, including the right to expect drivers to obey Reno’s traffic laws.
Nevada Revised Statutes (NRS) § 484B.280
Under NRS § 484B.280, a motor vehicle driver in Nevada is legally required to “exercise due care to avoid a collision with a pedestrian.” This means the driver must exercise proper caution not to strike a pedestrian who is on or near a street or highway, at or near a bus stop, or in or near a school zone.
NRS § 484B.283
Pedestrian rights-of-way within a crosswalk under NRS § 484B.283 state that motor vehicle drivers must yield the right-of-way (or slow down or stop) to yield to a pedestrian who is crossing a crosswalk within the half of the road in which the vehicle is traveling, or to a pedestrian who is approaching closely from the other side.
This law also states that a pedestrian does not have the right to leave a curb or place of safety to enter the path of a vehicle that is approaching too closely to yield. At an intersection or crosswalk with pedestrian signals, pedestrians may only proceed when faced with the “Walk” indication.
NRS § 484B.287
According to NRS § 484B.287, a pedestrian must yield the right-of-way to all vehicles upon a roadway when crossing at any point other than a marked crosswalk or intersection. In addition, pedestrians are not permitted to cross at a point between adjacent intersections that have traffic control devices in operation at any place besides a crosswalk.
How are People Injured in Pedestrian Accidents?
Pedestrians hit by a vehicle are at a great disadvantage. Occupants of vehicles are protected by tons of metal. But pedestrians are open to those tons of metal coming at them. Cars can hit walkers at high speeds and throw them from the accident scene. The result? Injuries ranging from the catastrophic, causing paralysis and loss of bodily function, to minor but painful. Common pedestrian accident injuries include:
- Fractured Bones & Contusions: Fractures and severe bruises are some of the most common pedestrian accident injuries, especially to the legs, hips, and pelvis. These can severely limit your mobility and be immensely painful.
- Lacerations & Loss of Limbs (Amputations): Serious cuts that lead to scarring, infection, or even an amputation are not only painful, but traumatizing, and can result in a serious change to your quality of life. We will fight for a full settlement.

How Do I Receive Compensation for My Injuries?
Our Reno Lawyers Will Help You Obtain Compensation for the Following:
If you are injured in a pedestrian accident, you may face large medical bills from doctors’ visits, hospitals, urgent care clinics, and more. If you aren’t able to work for a period of time, or unable to work at your former occupation, you may have financial difficulties. You may also suffer pain and emotional harm. Nevada law allows injured parties to receive compensation for the harm they suffered if another party was at fault. If a driver’s failure to drive safely and according to the law caused your accident, he or she was negligent in exercising the care Nevada expects of drivers. If a driver was negligent, you should contact a lawyer to help file a lawsuit against the driver’s insurance company. (All Nevada drivers are required to have insurance.) As a result, you may receive compensation for:
Medical Bills & Rehabilitation Costs
A key element of any personal injury claim involves repayment of any medical bills, equipment, and rehabilitation costs that were incurred as a result of your injuries. This can include ambulance transportation, emergency care, imaging, surgeries, medications, medical equipment, physical therapy, and other care that you received. Additionally, if your injuries are ongoing, your future anticipated medical expenses should be included in the settlement.
Past & Future Lost Wages
Most people will take at least some time off work to recover from their injuries after a pedestrian accident. For many people, the amount of time that they really need to fully recover from their injuries is much more than their accrued vacation hours. This can leave many individuals and families stressed as they wonder how they will pay the bills while they are forced to be out of work. A fair personal injury claim settlement will include compensation for all of your lost wages while you recover.
Lost Earning Capacity
If your injuries force you to reduce your hours at work, change to a new career, or stop working altogether, your Reno pedestrian accident law firm will calculate your anticipated future wages. This is known as lost earning capacity and will include the expected raises, bonuses, and other incentives you would normally or likely have earned if you had been able to continue in the career you had prior to the accident. It can be an essential part of your personal injury settlement.
Loss of Companionship
When someone else’s negligence or recklessness causes the death of a family member in an accident, you may be able to file a wrongful death claim against the at-fault party. Wrongful death claims frequently include compensation for the loss of companionship and/or loss of consortium that results from the death of your loved one. Your Reno wrongful death lawyer will be by your side every step of the way through this process.
Pain and Suffering
Injuries that result from a vehicle or pedestrian accident can be intensely painful. You may experience a great deal of pain and suffering as you work through trauma from the accident and take time to heal your injuries. Although it can be difficult to place a financial value on your suffering, your attorney will work to include it in your settlement.
Emotional Distress
This is another intangible loss that can be difficult to match with a financial value, but deserves to be included in your personal injury settlement. Emotional distress can include PTSD, anxiety, other mental health issues, and general distress and suffering from the aftermath of a vehicle accident, especially when a wrongful death resulted from the driver’s recklessness or negligent actions.

About Nevada’s Pedestrian Accident Laws
Nevada is an At-Fault State for Pedestrian Accidents
As with other vehicle accidents, Nevada is an at-fault state for pedestrian accidents. This means the party who is determined to be primarily responsible for the collision is legally obligated to pay for the losses and damages of the injured parties. Our experienced Reno pedestrian accident lawyers will fight for full compensation on your behalf. We will investigate the circumstances of your accident, uncover evidence, and build a strong case on your behalf as we fight for your interests.
Comparative Negligence Law
Nevada recognizes the law of comparative negligence, also known as contributory negligence. Often, more than one party is partially at fault for an accident. In these cases, the party who is at least 51% responsible for causing the accident is legally responsible for damages. Other parties who were partially responsible can still claim damages, but they will be scaled by the percentage to which they are determined to be responsible for the accident.
What is the Statute Of Limitations for Nevada Pedestrian Accidents?
Most personal injury claims in Nevada, including pedestrian accidents, have a statute of limitations of 2 years from the date of the accident. If you wish to file a personal injury claim against a reckless or negligent party, it’s important to do so as soon as possible. It can take months to uncover enough evidence to build a strong case in your favor. Waiting can be detrimental to your case.
