Your Rights as a Pedestrian in Reno

The State of Nevada has certain laws and statutes regarding pedestrian activity. If you decide to walk or jog around Reno, it is your responsibility to understand and obey these laws. Nevada Revised Statutes (NRS) § 484B.280

Under NRS § 484B.280, a motor vehicle driver in Nevada is legally required to “exercise due care to avoid a collision with a pedestrian.” This means the driver must exercise proper caution not to strike a pedestrian who is on or near a street or highway, at or near a bus stop, or in or near a school zone.

NRS § 484B.283

Pedestrian rights-of-way within a crosswalk under NRS § 484B.283 state that motor vehicle drivers must yield the right-of-way (or slow down or stop) to yield to a pedestrian who is crossing a crosswalk within the half of the road in which the vehicle is traveling, or to a pedestrian who is approaching closely from the other side.  

This law also states that a pedestrian does not have the right to leave a curb or place of safety to enter the path of a vehicle that is approaching too closely to yield. At an intersection or crosswalk with pedestrian signals, pedestrians may only proceed when faced with the “Walk” indication.

NRS § 484B.287

According to NRS § 484B.287, a pedestrian must yield the right-of-way to all vehicles upon a roadway when crossing at any point other than a marked crosswalk or intersection. In addition, pedestrians are not permitted to cross at a point between adjacent intersections that have traffic control devices in operation at any place besides a crosswalk.

Nevada’s in the Top 10 for Pedestrian Accident Deaths

Most people don’t think of walking as dangerous. But unfortunately, thousands of pedestrians are killed and injured every year in traffic accidents. Across the United States, 7,450 pedestrian fatalities occurred in 2017, the last year for which statistics are available, and nearly 129,000 pedestrians visited emergency departments for treatment of injuries.

Even more disturbing, it’s increasingly more dangerous to walk. Between 2007 and 2016, U.S. pedestrian deaths in traffic rose 27 percent—and this was in a period when all other types of traffic crash deaths were declining by 14 percent. Pedestrian deaths are currently at a 33-year high as a proportion of overall traffic deaths, according to the Governors Highway Safety Association.

Unfortunately, Nevada tracks these sobering trends. While the number of overall traffic deaths in the state fell, the number of pedestrian deaths rose in 2017, to 99, from 80 in 2016, according to the Nevada Department of Transportation.Reno Pedestrian Incident Accident Nevada ranks in the Top 10 U.S. states for the number of pedestrian deaths, coming in at number six, with 2.76 deaths per 100,000 persons. Nebraska, by contrast, is the lowest state, with just 0.68 deaths per 100,000.

Reno is a wonderful place to live, but in many ways, the city presents a perfect storm for traffic accidents involving pedestrians. The strip attracts both cars and people in great numbers, where they jostle under bright lights. According to the National Highway Traffic Safety Administration (NHTSA), more than three-quarters of all pedestrian fatalities occur in cities, and three-quarters also occur at night. Almost half—48 percent—involve either a driver or a pedestrian impaired by alcohol, according to the U.S. Centers for Disease Control and Prevention. Eighteen percent of pedestrian accidents occur at intersections.
