The popular Spanish Tapas restaurant, Firefly, ( the Paradise Firefly location) had an outbreak that hit local emergency rooms this weekend Health District shuts down Fire fly restaurant in Las Vegas for a food borne illness episode. Mr. Benson confirmed this with the health District environmental health department. The inspector confirmed the restaurant was in fact closed on April 26, 2013 due to multiple complaints of illness reported from patrons who dined. Food borne illness is a horrible sickness that causes extreme pain and discomfort. The law firm of Benson & Bingham, and its food poisoning lawyers are actively investigating the outbreak. The Bellagio Hotel and Casino ordered to pay $22,086.00 for guest who was struck in the head with an ice bucket in the Bank nightclub causing a laceration on her forehead. The California resident and nightclub patron retained Benson and Bingham to handle her matter. The hotel argued she ran into the bucket denying her any compensation. This case continues the streak of wins against Vegas nightclubs for the lack of care that continues to pervade and fester with nightclub management and their support staff. Military airman critically injured on his motorcycle represented by Joseph L. Benson II, Esq. in a pro-bono case received his insurance proceeds without need for government repayment of his medical expenses that exceeded over $350,000 for ICU care. "We are pleased that the US government had the heart to waive the lien amount given the catastrophic nature of the injuries including short term memory loss and permanent brain damage. While our client will never be whole again, the limited insurance proceeds are at least something he will benefit from given the tragedy, and we were glad we could assist a US service member who directly assists us all." |

Joseph L. Benson II, Esq. settled a case for $500,000 involving a rear-end accident that led to a lumbar fusion back surgery involving a pharmaceutical representative. The surgery was quite involved requiring both an anterior and posterior incision. "We were very happy with the ultimate result given our client had no real change in her MRI results before and after the accident so the arguments for exacerbation of the spinal injury were there, but so was the pre-existing condition argument. Our client had a good surgical outcome and we are very happy her residual complaints are minimal."
Our client will be netting $350,000 in her pocket after all expenses and we feel this is a good outcome. |

DISCOUNT AIRLINE SUED OVER LIFE SAVING DEVICE
The law firm of Benson & Bingham files Federal Lawsuit against Spirit Airlines, Inc., for failure to supply and/or use an automated external defibrillator (AED) on a passenger for a flight bound for Las Vegas from Detroit, Michigan. The discount airliner is alleged to have violated Federal Aviation Regulation 121.803 when an ailing passenger suffered a heart attack on board the flight on December 14, 2011. That rule requires AED’s onboard all commercial passenger flights in the U.S. It is believed that CPR was given for 50 minutes; however, use of an AED was not believed to have been used. The passenger later died at Creighton University Hospital in Omaha, Nebraska after the Captain made an emergency landing. She was taken off life support and pronounced dead on December 16, 2011. The heirs, through their attorney Joseph L. Benson II, Esq., filed the complaint for Negligence and Negligence per se. “This is a classic example of costs savings over safety. If proven to be true, there is a clear violation of federal law that in all likelihood could have saved our clients’ mothers life. It is well known that AED’s provide crucial help if used within a few minutes of a cardiac arrest—hence, why we have the law, and why they should be on board. The medical community has stated that every minute of delay is a 10% decrease in the survival rate. Our clients’ mother lost that opportunity.”

The natural Heirs of an elderly pedestrian hit by commercial van in a marked crosswalk have hired Joseph L. Benson II, Esq. to represent them and the deceased's Estate against the driver and Van owner. The incident brings more attention to the fact that Las Vegas is on pace for the most deadly year of car accidents ever. As the pedestrian left her parked car she was run over sustaining neck injuries that eventually took her life. The Van was backing up to a loading dock. The investigation is ongoing. This is the second wrongful death case for Mr. Benson just this year.

Joseph L. Benson II, Esq. of Benson & Bingham orchestrated a successful double verdict against American Access Insurance and their insured in Clark County District Court today. The insurance company would not offer even the medical expenses for an accident that occurred in 2008 when their driver blew a stop sign. The short trial verdict came in at a combined value of over $25,000 for the landscapers who were hit in their work truck and suffered neck and back strains. Mr. Benson is undefeated in the Clark County Short Trial Program. |

It is reported that one victim dies and six others critically injured when their vehicle rolled due to what could be a defective tire tread. Most of the occupants were ejected due to the centrifugal force of the rollover event. Occupants can be ejected even when wearing seat belts given the inertia of gravity and the forces involved. |

The family of woman who died in a Spirit Airline’s flight from Michigan to Nevada retains Benson & Bingham. The woman died of a heart attack or ventrical fibrillation, and it is alleged the airline did not have an external defibrillator on board as required under Federal Law and/or failed to use one if they did have it on board. As of 2005, all airlines are required to possess a defibrillator under CFR Sec. A121.1 The American Heart Association (AHA) states that, after approximately three to five minutes, irreversible brain tissue damage may begin to occur. For every minute that a person in cardiac arrest goes without being successfully treated (by defibrillation), the chance of survival decreases by 7 percent per minute in the first 3 minutes, and decreases by 10 percent per minute as time advances beyond (3) minutes. The law requires that to prevent further injury all airlines have an Automated External Defibrillators on board. At least one approved automated external defibrillator, legally marketed in the United States in accordance with Food and Drug Administration requirements, that must: 1. Be stored in the passenger cabin., 2. On and after April 30,2005, meet FAA Technical Standard Order requirements for power sources for electronic devices used in aviation as approved by the Administrator, and 3. Be maintained in accordance with the manufacturer's specifications. AED’s or Automatic External Defibrillators Save lives and improve the chances one may have in an life saving situation involving heart attacks. |
