Vehicle Accident Injures 4, Kills 3 in Las Vegas

Head-on collision auto accidents can be among the worst possible vehicle accidents for injuries and fatalities. This type of accident is so much more dangerous because the speed of the vehicles that hit each other is magnified when they are travelling in opposite directions, thereby compounding each other’s speed. Often times, these accidents occur because of one driver driving the wrong way – either down a one way street or driving on the wrong side. While these types of scenarios can make for adrenaline pumping sequences in highly-choreographed action movies, in real life they often end in terrible tragedy. Such was the case with a recent wrong-way crash in Las Vegas that critically injured four people and killed three others. If you’re ever injured in a terrible, tragic car accident like this, or a loved one is killed, call Benson & Bingham Attorneys at Law. We can take care of your case swiftly and effectively, giving you and your loved ones time to heal, and grieve, without worrying about legal ramifications.

April 26th, 2013 No comments

The man in a story we have written about before, the suspected shooter in a potential wrongful death case in Las Vegas who is alleged to have been involved in an auto accident and gun shooting incident, was indicted today by a grand jury in Clark County. In addition to the previous charges, he faces a new count of sexual assault from a case dating back to 2010. The grand jury indictment included 11 counts – first degree murder of three, attempted murder of one, and more – all from a sensational, headline grabbing incident in February. The alleged perpetrator began shooting at the other vehicle as both cars headed north in the direction of Flamingo Road. The driver of the other vehicle and his passenger were struck by bullets, and the driver lost control of his vehicle. The car then blew through a red light and smashed into a taxicab, causing the taxi to burst into flame. A passenger in the taxi, the driver of the taxi, and the driver of the vehicle that collided with the cab died as a result of their wounds from the accident; three wrongful deaths in the Las Vegas Valley.

April 19th, 2013 No comments

It took some time for the extradition to take place because a California wanted to be 100% sure that Harris was the same man wanted in the Las Vegas wrongful death and automobile accident case. Widow Laments Anniversary of Veteran’s Las Vegas Wrongful Death

December 12th, 2012 No comments

It happened a year ago, but the widow of a man murdered last Christmas still cannot cope with her loss. The white Cadillac in which the man died, and had once been the entire family’s pride and joy sits, unused, unfixed rotting. Rhonda Gibson, the widow of Stanley Gibson, a post-traumatic stress disorder suffering gulf war veteran was  killed in a Las Vegas apartment complex last December 12th by Las Vegas Metro Police when they attempted to remove Mr. Gibson from his car. If you has lost a loved one to a Las Vegas Metro Police wrongful death accidents, contact the attorneys at Benson and Bingham for a free legal consultation today.

Last December, off his medication, disoriented, lost and panicking, Mr. Gibson pulled into an apartment complex that looked very similar to the one he has just moved into. The honorably discharged veteran was sitting in his white Cadillac when residents of the apartment complex grew concerned and eventually called police. Las Vegas Metro surrounded Mr. Gibson’s car and ordered him, weapons drawn to exit the car. When Mr. Gibson refused, officers on the scene devised a plan to fire a beanbag round into his window, and pull him from the car. Instead of a beanbag round, however, the officer fired a live shotgun round. When the shotgun round went off, a startled Las Vegas police officer, Jesus Alvarado, fired seven shots from his assault rifle killing Gibson at the scene. Losing a victim to a Las Vegas wrongful death can be emotionally and financially devastating. Contact Benson and Bingham to recover costs like lost income, hospital bills and even pain and suffering.

Las Vegas Casino Assault Tragic for Both Parties

November 30th, 2012 No comments

In July 2011, 46-year old John Massie and 39-year old Benjamin Hawkins were both enjoying their Las Vegas vacations partying with friends at the now closed O’Sheas casino on the Las Vegas strip. While the gentlemen had never met, the events of that evening would impact them and their families potentially for the rest of their lives. If you have lost a family member in a Las Vegas wrongful death accident, contact Benson and Bingham today to start discussing your case.

Mr. Hawkins entered a bathroom at O’Sheas and he has testified that Mr. Massie made a comment pertaining to Mr. Hawkins race and the fact that he was wearing a yellow shirt. Events escalated, to the point where Mr. Hawkins punched Mr. Massie in the face. As Mr. Massie fell to the floor, he died from the blunt force of his head striking the floor. Mr. Hawkins contends that he struck Mr. Massie out of self-defense, but the Clark County DA’s office disagreed and charged Mr. Hawkins with involuntary manslaughter.

This week, Mr. Hawkins was tried in Clark County courts, and was judged guilty in the Southern Nevada wrongful death accident. Mr. Hawkins now faces a maximum sentence of 4 years in jail due to the accident. If your immediate relative has been killed in a Clark County wrongful death tragedy, contact Benson and Bingham for a free legal consultation today.

Worker Killed Repairing Las Vegas I-5 Freeway

November 29th, 2012 No comments

Injury accidents happen all the time in Las Vegas: in casinos, on our roads, our highways, workplaces, everywhere. These accidents can happen to anyone – tourists, children, the elderly, people commuting to work, even people at work. When an accident happens at work, it can either be the fault of the employee or the employer, and when an accident does happen, often the injured is eligible for Las Vegas workmen’s compensation coverage. When someone is injured in the workplace, an individual should always hire an attorney to represent them and not immediately take the offer from their employer’s insurance company. Your employer and their insurance agency do not work for you, and instead have a goal of saving money. Contact Benson and Bingham today for a free legal consultation about your Las Vegas workmen’s compensation case.

At other times, a workplace injury can turn even more tragic when it results in a Las Vegas wrongful death. An example of one of these tragic occurrences happened yesterday when a worker was killed on the job fixing a stretch of Las Vegas Interstate 15. This Southern Nevada wrongful death accident occurred when a man was crushed by falling debris while performing road maintenance. As is the case in all of these tragedies, both the Nevada and federal Occupational Safety Administrations were investigating the accident.

Benson and Bingham, one of Las Vegas’ leading personal injury law firms, represents people injured in Southern Nevada through no fault of their own. Our Nevada licensed attorneys have represented individuals or their surviving family members in cases of Clark County wrongful death, Las Vegas pedestrian accidents and Nevada product liability. Nevada Mining Firm Cited for Negligence After Workplace Death

Mines in Nevada and the United States are under the jurisdiction of the United States Mine Safety and Health Admin, and this week they released their report on an October, 2011 accident at the Newmont Mine in Carlin, NV. The MSHA’s report stated that the Elko, NV based company was negligent in failing to establish controls and procedures for the repair of trucks and other vehicles with toxic chemicals. The report also stated that the repair shop where vehicles were fixed was poorly ventilated. The Open pit at the South Area of the mine had over 1100 workers in the area. If you have a relative that has been killed in a Nevada workplace accident, contact Benson and Bingham for a free legal consultation today.

While fixing the tires on a mining truck, 21-year old Joe Ashdown was overcome by fumes from a chemical he was using. The area where the repair shop was located lacked adequate ventilation for use of the chemicals. In addition, Mr. Ashdown did not have a gas mask or other breathing apparatus necessary for using such harmful solvents. The company was also cited for assigning Mr. Ashdown to work on repairing the tires alone, without supervision and out of view from his co-workers. If you have lost a relative in a Las Vegas workplace wrongful death accident, Benson and Bingham can help you recover money spent on medical bills, lost work and pain and suffering.

Benson and Bingham is one of the leading Las Vegas personal injury law firms that focuses on Las Vegas personal injury, Clark County wrongful death and casino accidents across the United States. Former Army Sergeant From Guam Dies In Las Vegas Police Custody

Modern American families are spread across the country. While for years, people stayed in the town they grew up in or possibly in the closest major city to the town they grew up. In those days, the death of a close family member was easier for surviving family members to handle. They often knew an undertaker they had worked with in the past. They could travel to the hospital or morgue where their relative was easily and quickly. They possibly even knew some of the police investigating the case. Today, however, when a family member passes in another city across the country, family members have significant challenges. In wrongful death cases, these challenges are multiplied. Selecting an attorney can be difficult in the best of circumstances, however, when you are faced with the untimely death of a close family member, the challenge can be even greater. Should you have a family member that has died in a Las Vegas wrongful death accident, whether he or she was a resident or had a Southern Nevada vacation injury, the family run personal injury law firm, Benson and Bingham is best positioned to represent you.

This is the very problem that the family of Glenn Ybanez is facing. The 37-year old retired Army Sergeant died unexpectedly this week in the custody of Las Vegas Metro Police. Mr. Ybanez was a passenger in a car pulled over in a routine traffic stop and when Metro police determined he was wanted on warrants in Colorado and they tried to arrest him, he fled on foot. After running just under 1000 feet, the former Guam resident was detained by police and two civilians. Moments after being handcuffed, Mr. Ybanez stopped breathing and was rushed to a local hospital where he died days later. Mr. Ybanez brother suspects this is a case of Southern Nevada wrongful death due to the fact that his brother was an experienced jujitsu fighter and in great shape.

Benson and Bingham have been practicing personal injury law in Las Vegas since 2003. Our firm specializes in Clark County wrongful death cases, casino injury cases and even car accident injuries.

Nevada Mining Companies’ Safety Violations Threaten Nevada Worker Safety

Nevada is in the midst of a whole new gold rush – Northern Nevada’s soil contains more of the metal that is used for currency, in medicine, electronics, computers and of course, jewelry. Mining companies and their lobbyists talk of the high paying jobs their industry provides – the average pay annually for a miner is approximately $83,000. The companies also talk of their commitment to safety. Those working 1,000 feet below the surface (equal in depth to the height of the Empire State Building) are supposedly equipped with a bevy of safety devices. For fire safety, miners are equipped with a self-rescuer that enables miners to create life saving carbon dioxide from deadly smoke fumes like carbon monoxide. Helmet lamps have wireless tracking devices embedded into them. Miners also have to digitally sign in and out at the start and end of each shift. However, Nevada mining company’s history on worker safety is not pristine. If your relative has been injured or killed in a Nevada mining accident, we are deeply sorry for your pain and suffering. Contact the personal injury and wrongful death attorneys of Benson and Bingham today for a free legal consultation.

As we stated above, Nevada mining companies’ records on worker safety leaves much to be desired. In May 2011, the federal agency that inspects and licenses mines, the US Mine Safety and Health Administration (MSHA), fined Barrick $70,000 for violating worker safety standards. In November 2011, MSHA found 13 “significant and substantial” Nevada worker safety violations at the Jerritt Canyon Mill. In the report the MSHA forced the company to remove workers from many sections of the mine. In addition, even though Nevada mining companies have recently secured record profits, they have not offered to help fill the vacancies of the two State of Nevada mine safety inspector positions that are vacant. If a Nevada mining accident has led to the injury or death of a loved one, Benson and Bingham can help you to recover lost wages, medical bills and pain and suffering.
