Ford Recalls Hundreds of 2013 Escapes Sold in Nevada

Today’s modern automobiles are extremely complicated. On a normal internal combustion engine, computers control the firing of spark plugs, the carburetors air to fuel ratio and even repeatedly checks the exhaust to ensure it meets pollution requirements. Today’s braking systems are designed to prevent hydroplaning and roll overs. With robotic brains that control nearly all the vital systems of today’s cars, it’s amazing that they continually work correctly and it’s even more amazing when simpler aspects of the car’s designs are the cause of defects. If you have been injured in a Las Vegas defective product case, contact Benson and Bingham for a free legal consultation.

This weekend, the Ford Motor Company announced that it was recalling over 10,000 Ford Escape SUVs. In the 2013 model of the very popular truck, the carpet and carpet padding have been shown to shift and prevent drivers from braking and accelerating the vehicle. In the wrong circumstance, this could cause the Ford Escape to crash. The recall covers nearly 8,300 SUVs sold in the United States and 2,000 in Canada. At this time, no accidents have been reported. The Ford Escapes were built between March 8th and June 7th. If you have been involved in a Southern Nevada accident with a defective Ford Escape, Benson and Bingham can help you to recover money to repair your vehicle, medical bills, lost work and pain and suffering.

January 9th, 2012 No comments

Las Vegas Metro Police recently forwarded the results of their investigation into the 2010 death of 2-month-old Miowne Obote. The infant, at Las Vegas’ Sunrise Children’s Neonatal Intensive Care Unit, died when the catheter that had been applied broke. Before the death, many nurses and other health care workers at the hospital complained to upper management about repeated catheter failures. If you believe you have been injured or a loved one has died as the result of faulty medical equipment, and would like a free consultation with an attorney, contact us at Benson and Bingham today.

After the death of Baby Miowne, two nurses at Sunrise Children’s Neonatal Intensive Care Unit in Las Vegas, Jessica May Rice and Sharon Ochoa-Reyes, were fired and investigated by Las Vegas Metro Police after the child’s death was ruled a homicide by the Clark County Coroner’s office. Both women were fired and their licenses were suspended. Eventually the nurses’ licenses were reinstated when the State of Nevada Nursing Board found no evidence of wrongdoing. Illegal NV Surgery Leaves Woman Dead

January 3rd, 2012 No comments

In April, 42-year old mother of three, Elena Caro, went into Tiles and More on Charleston Ave in Las Vegas for buttocks enhancement surgery. If you or a loved one has been injured or killed in a case of Nevada medical malpractice, contact us today.

Today, the family of Ms. Caro filed suit against the owners of Tiles and More, who had leased space to Mr. Matallana-Galvas and Ms. Torres-Sanchez and Sinaloa Beauty Salon, who had referred Ms. Caro to the illegal surgery practice. Poor NV Economy May Spur Rise in Malpractice Cases

January 1st, 2012 No comments

As the Nevada Cancer Institute bankruptcy proceeds, patient care concerns have been in the forefront. Under Nevada law, when a medical institution has filed for Chapter 11, the court should appoint a health care ombudsman, to ensure patient care does not suffer. At this time, no ombudsman has been appointed as the Nevada Cancer Institute is currently not facing any malpractice claims. If you believe you or a loved one has been injured or killed in a case of Nevada medical malpractice, contact us today.

As the economy continues to struggle, and more Nevadans eschew health insurance in lieu of buying groceries and paying rent, Las Vegas hospitals as well as those across the Silver State are facing financial difficulties. Hospital staffs across Nevada are being asked to work longer hours and make due with fewer resources. Because of this, the potential for mistakes, negligence and poor care are greater. If you feel you have gotten substandard medical care due to negligence in Las Vegas or malpractice in Clark County, please contact us today.

Las Vegas law firm Benson and Bingham represents its clients be striving to ensure their satisfaction. We handle Las Vegas accident, injury, negligence and liability cases across Southern Nevada. Please contact us today at BensonBingham.com or 702-382-9797 for a free consultation.

Breaking: horrific Nevada air accident unfolds at Reno Air Races

September 16th, 2011 No comments

As many of our readers already know, a tragic scene is still unfolding north of Reno at the annual Reno Air Races. The event is no stranger to misfortune — in recent years several planes have been lost and pilots injured or killed due to human error during precision maneuvers or as a result of faulty engine components that raise issues of Nevada product liability. But at approximately 4:30 pm today, a tragedy of an entirely different nature took place: a Nevada Air accident unlike any other seen.

An 80-year-old, experienced pilot with some ten dozen races under his belt apparently lost control of his aircraft during a race at the event today at the Stead Air Field, north of Reno. Early witness reports indicate that the plane went nose-up before falling vertically. The aircraft seemed to be headed toward one of the main grandstands full of spectators but at the last moment plowed into a space that is being described as a VIP area and/or information technologies hub. Those in the grandstands were spared grave personal injuries or worse, but as is so often the case with these events the changing winds of fate blew misfortune onto those who were struck instead. The pilot is presumed dead and reports confirm that there will be fatalities from this tragedy. Early estimations venture that between 40 and 50 people were injured, with many being treated for injuries at area hospitals. One report puts at eight the number of those who are in critical medical condition, perhaps needing treatment for serious brain injuries.

Tragic events like these must always give us pause, and our thoughts go out to those families affected by this tragedy and to the larger Reno community that is grappling with a shadowy period for an otherwise celebrated community event. In the weeks and months ahead, concerns about pressing medical issues will evolve into difficult conversations about legal action including possible Nevada wrongful death lawsuits against the Reno Air Races executive agency. Air races officials are saying that exhaustive safety checks were undertaken before the race, and it is possible that a factor such as product defect, human error, or just freak bad luck is responsible for this awful occurrence.

Nevadans hope for a hunting season free of hunting injuries and accidents

August 30th, 2011 No comments

Hunting season is upon us in the Silver state. Archery hunters are already scrambling through the hills in search of “the big one” and bird hunters are eagerly awaiting September 1st when dove, snowcock and grouse open. Hunting is generally a safe hobby in which participants take some time and enjoy the beauty of the Nevada back-country and attempt to reconnect with nature without substantial risk of Las Vegas personal injuries.

Unfortunately, there are numerous injuries every year caused by poorly designed or defective products that fail when used or by poor decisions by other hunters. Every hunter has heard the horror stories of someone enjoying time in the hills looking for a deer or some chukar only to be scared out of their mind by someone just over the next knoll shooting in their direction. The vast majority of these situations end in a harmless apology from one party to another, but occasionally someone is either seriously injured by a Nevada brain damage injury or worse.

Whether one is injured by a faulty product or by the tragic carelessness of another hunter that results in a Nevada wrongful death it is imperative for the injured to be adequately represented. An experienced attorney is essential to prove that a victim was injured through no fault of their own and that the other party acted irresponsibly or with negligence. In the worst cases of Nevada hunting injuries often alcohol or another impairing substance is part of the equation.

We hope our outdoorsy readers will enjoy the beauty and peace in the wild places of Nevada but that they will do so safely. And if another has failed to do so or a product has failed to live up to its representation, remember that a skilled Las Vegas hunting accident attorney is here to help.

Stage accident at state fair results in death, personal injuries

August 14th, 2011 No comments

The nation begins another challenging weak of slow economic growth and fickle stock markets with more bad news: five people are dead and many more have suffered personal injuries after a freak accident toppled a stage at the Indiana State Fair. According to reports and video of the event, a strong gust of wind compromised the poles supporting the roof of the stage and it came crashing down upon dozens of people with tragic results.

It is thankfully a rare occasion that an event such as this results in a stage show accident, but these tragedies are not unheard of. Especially in the state of Nevada, tourists are hurt every year in Las Vegas casino show accidents. That accidents like this have happened before is little consolation to the families affected by this tragedy that interrupted the celebratory air and calm of a state coming together during an annual fair.

Before a crowd of some 20,000 people, a strong gust first ripped the curtains from the stories-tall stage. The metal structure lurched from side to side and then one of the main vertical supports buckled. The stage roof collapsed upon itself and the heavy structure came crashing down upon those on and near the stage. Five people are dead and dozens more injured from the tragic event, and as investigations continue the obvious question is whether bad luck or negligent design is more to blame.

Our thoughts are with the families of those injured and killed in this tragic accident. A sad necessity of the aftermath will be investigations and the commencement of wrongful death lawsuits aimed at making whole again those who lost loved ones so abruptly. If you need legal advice in a Nevada personal injury case, contact us today for a free consultation.

Tainted medical supplies add insult to injury for Las Vegas medical patients

For some Nevada accident victims, the pain and risk of recovery can be worse than the injury was in the first place. Imagine the frustration some families feel as they attempt to seek care for their sick loved ones: they took responsibility and purchased costly medical insurance, paying hundreds of dollars every month in insurance premiums; after the Las Vegas automobile accident, they went to an approved care provider and waited patiently for the urgent medical care; and they paid the substantial deductibles and admittance fees. But for some families, all this diligence is not enough.

Although rare, there have been reports recently of unsafe inputs and implements that can entirely compromise the integrity of 21st-century medical treatments. Not only can Nevada tainted medical supplies undermine the care that is vital to Las Vegas accident victims, they can actually turn the curing power of modern medicine on its head by creating Nevada medical treatment harm.

The details of these incidents are disturbing: iodine prep pads infected with potentially lethal bacteria, a variety of other alcohol-based cleaning wipes, tainted surgical implements. These events combine with recent reports of over-the-counter remedies with foul or chemical odors, medications with dosages higher than intended, and even HIV drugs contaminated with dangerous anti-fungal compounds.

If you believe that a loved one’s medical recovery has been compromised or worsened due to sub-standard medical inputs, contact our Nevada personal injury lawyers to learn more about legal actions affecting victims of tainted medical supplies.

Toyota recalls 300k RAV4 and Highlander vehicles over concerns of Nevada injuries from faulty side airbags

Nevada Toyota owners are once again on alert as the Japanese company has issued a recall of more than 300,000 of its vehicles, these sport-utility vehicles in the popular RAV4 and Highlander models. Once held up as the paragon of disciplined engineering and manufacturing reliable automobiles, Toyota has seen its image upended over the last two years with a series of Toyota vehicle recalls.

This recall affects nearly 214,000 RAV4 vehicles in the 2007 and 2008 model years and Highlander SUVs from the 2008 cycle. These automobiles were popular among Nevada drivers because of the car company’s strong reputation and the relative boom period that the state was enjoying just before the housing bubble burst, the financial crisis hit, and Nevada’s economy was left in a shambles. Today, those Nevadans lucky enough to have jobs are finding themselves increasingly in lower-wage jobs with few benefits, and many families are having to bear the risk of Nevada workplace injuries just to keep food on the table.

The targeted vehicles are thought to have flawed side-airbag sensors that may not function properly. Side airbags have been a crucial development over the last ten years of automobile technology, credited with preventing serious injuries in Nevada vehicle rollover accidents by keeping passengers in the vehicle and limiting harm from the vehicle’s hard shell. In fact, Toyota was an early adopter of this technology in the late 1980s. But as this recall demonstrates, a side curtain airbag is of little use if it remains compressed in the vehicle’s side panels. A faulty airbag sensor can result in the non-deployment of an airbag, permitting injuries that should have been stopped and which car owners expected to be combated by the advertised safety features. Additional forms of Nevada product liability come from faulty airbags in the form of late or sudden deployment of the airbags, which can actually exacerbate injuries instead of preventing them.

If your family owns one of the recalled vehicles, you should contact your car dealer and find out the details of the recall to ensure that your car receives any attention or maintenance that it needs. If a loved one has been hurt in an accident involving one of these malfunctioning SUVs, contact our team of Las Vegas automobile injury attorneys today for a free consultation.
