American Academy of Pediatrics Lobby For Increased Bicycle Helmet Use In Las Vegas

Since Nevada does not have mandatory helmet use for bicyclists, local agencies and non-profits need to be creative to get the helmet use message out. The American Academy of Pediatrics recently expanded their “Put a Lid on It” campaign to the Southern Nevada Las Vegas area. When a bicyclist is in an accident when not wearing a helmet they are more likely to be fatally injured in that accident. The institute reports that 70% of those killed in the 600 bicycle fatalities in the United States in 2010 were due to lack of helmet use by the cyclist. If you have been in a Las Vegas automobile bicycle accident and were injured, even if you weren’t wearing a helmet, contact Benson and Bingham for a free legal consultation.

Physicians who work in Emergency Rooms attest that helmet use reduces the chances of head injuries from a Nevada bicycle automobile accident by 85%. While automobiles injure the most children in the United States every year, bicycles are ranked second in consumer product injures of kids. 21 states have mandatory helmet use laws, however, Nevada doesn’t. The insurance institute of Highway Safety tracks helmet use laws and legislation on their website. Emergency rooms have compiled statistics for head injuries from bicycle accidents. 62% of bicycle related deaths are from head injuries. Emergency room visits due to bicycle accidents are 33% because of head injuries. For those admitted to a hospital due to a bicycle accident, 67% of those people have head injuries. If you have suffered a Las Vegas head injury due to a Southern Nevada bicycle accident, contact Benson and Bingham to discuss recouping money due to lost work, medical bills and pain and suffering.

The personal injury attorneys at Benson and Bingham have significant experience in head injury and Las Vegas automobile accident cases. In 2010 and 2011, we were able to secure $24,000,000 in personal injury awards for our clients.

Las Vegas Metro Police Fatal Shootings Reviewed

April 20th, 2012 No comments

Las Vegas Metro Police continues to investigate their actions in the spate of officer involved shootings over the past few years. In fact the District Attorney’s office for Clark County has just issued a report on two shootings from 2010. One of the shooting victims was Eduardo Lopez-Hernandez. Before he was shot, in a struggle with Las Vegas Metro, he had been tasered 19 times. Police had been trying to prevent the man from running into traffic. Steve Wolfson, Clark County’s District attorney, disagrees with the family of Mr. Lopez-Hernandez that excessive force was used. If you or a family member has been injured or killed in a confrontation with Las Vegas Metro police and would like to discuss your personal injury or wrongful death case, contact the attorneys at Benson and Bingham.

The other report released by the Clark County District Attorney’s Office was regarding the shooting death of Anthony James Brenes from November 2010. Prior to the fatal shot that ended his life, Metro police had attempted to subdue him first by firing a bean-bag projectile and then with a taser. Mr. Brenes has been waving a stick threateningly at police as they attempted to subdue him. As he moved towards the Las Vegas Metro Police officers, he was shot dead. This had not been Mr. Brenes first interaction with Metro PD – he had been taken into custody two times for domestic battery. If a loved one has been killed in a Las Vegas PD wrongful death incident, contact Benson and Bingham for a free legal consultation. While we can make no promises your case will be successful, our attorneys can help you get reimbursed for pain and suffering, lost work and healthcare costs.

We here at Benson and Bingham pride ourselves on our happiness guarantee. If, upon the conclusion of your case, you feel we have not earned our fee, we will work with you to arrive at a price you agree with.

Las Vegas Hangover Cure Provokes Medical Safety and Ethical Questions

April 12th, 2012 No comments

You head to Las Vegas with friends to celebrate a bachelor’s or bachelorette party. Maybe it’s your annual weekend in Vegas for you and your buddies to draft your fantasy teams. You arrive on Friday night, check into your hotel and head down to the blackjack tables, that later lead to a club, then another club. You wake Saturday morning with the worst hangover of your life, wondering how you will get through the day, disappointed you’ll miss hanging out at Rehab with your friends. Then you remember Hangover Heaven and you place the call. They come to pick you up in their bus, and hook you up to intravenous therapy and you get ready to kick off the day. However, in your diminished state, you fail to realize the negative effects prescription drugs like Ondansetron and Ketorolac can have on your body. If you have fallen victim to Las Vegas medical malpractice scheme and wish to recover money for lost work, medical bills or pain and suffering, contact Benson and Bingham for a free legal consultation today.

The hangover bus has received significant attention in local and national media including concerns from physicians on both the safety and efficacy of the treatment. Despite Increased Enforcement Efforts, Las Vegas Pedestrian Deaths Continue to Climb

So far this year, thirty eight people have died in traffic fatalities in Las Vegas. The latest Las Vegas traffic fatality happened early this morning when a 60-year old woman stepped into traffic on Sahara Avenue and was struck by a 2010 Altima. She was pronounced dead at Univ. Medical Center. If you or someone you love has been killed or injured in a Las Vegas pedestrian accident, contact Benson and Bingham for a free legal consultation today.

The epidemic of Las Vegas pedestrian accidents has spurred local and state authorities to increase funding for a host of traffic safety measures. The Nevada Dept. of Public Safety is still in the process of supporting Southern Nevada communities through the Joining Forces grant program. This program supports Nevada’s municipalities and counties with saturation traffic patrols and public awareness media events with regards to various public safety traffic issues. The Joining Forces grants usually go to improving traffic safety by curbing the most dangerous Nevada driving practices such as driving a motorcycle without a helmet, driving while intoxicated, speeding, teen driving, transporting children without proper restraints and seats, driving without a seatbelt and more. If someone you love was injured or killed in a Clark County pedestrian accident, contact Benson and Bingham today.

Las Vegas DUI Accident Results In High Medical Bills for Family of Injured 15-Year Old

Sunday Morning, April 5th, it is alleged that Noel Laredo, a 26-year old now-former teacher of first graders was driving her 2005 Acura on Spring Mountain Rd. in Las Vegas. Witnesses say that the Acura she was driving ran a red light and skidded, then ran off the road and crashed into a bus stop where 15-year old Conan Obenchain was waiting. Mr. Obenchain’s left leg was severed in the crash and his right was nearly chopped off – attached only by some muscle and skin. The boy was rushed to the University Hospital. Police performed sobriety tests on Ms. Laredo, in which she failed four of them. Two open containers of vodka were in found in Ms. Laredo’s Acura. At a recent pre-trial hearing, Ms. Laredo’s attorney offered up many alternatives to the Las Vegas Metro Police Department’s assertion that she was drunk. Some of the theories proffered were improperly inflated tires, uneven pavement, malfunctioning breaks and diabetic shock. If you or someone you love have been injured or killed in a Las Vegas DUI accident, contact Benson and Bingham today.

The past few months have been very difficult for Conan Obenchain, understandably. The doctors attending him initially felt that the 15-year old’s leg was lost. The Obenchain family estimates that over $1,000,000 has already been spent on healthcare for Conan since the accident. As Conan Obenchain detailed his injuries during Ms. Lardeo’s recent pre-trial hearing, the former first grade teacher sobbed. While the accident is a tragedy for all involved, the Obenchain deserves recompense for the pain and suffering they have been through, the medical bills they have incurred, the work the parents have missed and even for care for Conan as he lives his life. If you have been in a similar Las Vegas automobile accident, please contact Benson and Bingham.com for a free legal consultation today.

Earlier this week, on Monday, the record setting pace of the Las Vegas pedestrian death toll continued its steady climb. Nevadans Fear of Trayvon Martin Like Killing in Las Vegas Unfounded

Americans across the country are rightfully angered by the murder of Trayvon Martin by George Zimmerman. The African American was 17-year old, and unarmed when he was shot. Mr. Zimmerman has said he shot Mr. Martin in self-defense, saying that the 17 year old had struck him twice. The specific law being cited by Mr. Zimmerman is Florida’s “Stand Your Ground” law which gives those being attacked the right to use lethal force to protect them. The law is similar to other stand your ground statutes the National Rifle Association has lobbied to get passed across the country. Even Nevada has a version of the stand your ground law – which enables someone whose home has been breached to defend himself or those he believe are in danger. If you have been injured or a loved one has suffered from wrongful death in Las Vegas, and you believe the person in incorrectly being shielded by a Nevada castle doctrine bill, contact Benson and Bingham for a free legal consultation today.

Nevada’s stand your ground or castle doctrine law does not go as far to protect the shooter as the Florida law. In Florida, should someone claim they were standing their ground while being attacked, the police have no duty or requirement to arrest and detain the assailant. In Nevada, for someone to claim self-defense, the attack on them must be unprovoked. In addition, the Nevadan trying to defend themselves must be acting on fears that must be deemed reasonable. Finally, the Las Vegan must fear death or significant bodily harm, with deadly force being the only way the attack can be stopped. This is a significantly hirhger burden than the Florida law – so, if a Nevadan you love was murdered and the assailant wrongfully claims self-defense, the personal injury attorneys at Benson and Bingham could help you receive reimbursement for pain and suffering, lost wages and medical bills.

Nevada DOT Compiles Las Vegas and Nevada Accident Data and Reports Findings

March 31st, 2012 No comments

The Nevada Department of Transportation and the University of Nevada School of Medicine have created a database that tracks the medical costs from individual auto accidents in conjunction with the states four trauma hospitals. The four hospitals are Southern Nevada’s University Medical Center, Dominican Hospital, Sunrise Medical Center and Reno Medical Center. The data is being compiled to aid state and municipal lawmakers in traffic management. It has also brought to light the added costs associated with drunken driving accidents, driving without a seatbelt or operating a motorcycle with and without a helmet. If you have been injured in a Las Vegas traffic accident, while your data will be compiled, and while it may one day be used to increase the safety of Las Vegas and Nevada’s roads, you should still seek representation to ensure you are reimbursed for pain and suffering, lost work and medical bills.

Some of the data presented by the study’s newsletter, TREND, aligns with commonly held beliefs, others are very illuminating. Helmet use by motorcyclists is consistent whether or not alcohol was involved. The total cost across Nevada for pedestrians without health insurance injured in traffic accidents was over $64,000,000 from 2005 to 2010. While alcohol or drug use increases the likelihood of a traffic accident, it also increases the medical costs associated with the accident by nearly $20,000. If you have been involved in a Las Vegas traffic accident, contact Benson and Bingham for a free legal consultation today.

Benson and Bingham was founded in 2003 by cousins Joseph Benson II and Ben Bingham  to provide representation for car accident, wrongful death, personal injury and spinal cord/brain damage cases. Las Vegas Continues to Debate Additional Penalties for Aggressive Dog Attacks

March 11th, 2012 No comments

As Las Vegas, Nevada debates changes in punishment for the owners of dogs that attack others, more and more people have been injured and nearly killed. The breed that seems to always come under scrutiny, pit bulls, are yet another breed that has raised the ire of the American people. Over the decades, many dog breeds have been accused of over aggression – Rottweilers, German Shepherds, etc. Many dog lovers do not believe various breeds are the problem behind the attacks. Instead, these advocates for canines state that any dog, when mistreated and rewarded for acts of aggression can become violent and attack innocent people and canines. If you have suffered a Las Vegas dog attack, and wish to sue for lost work, pain and suffering and for the medical bills you have incurred, contact Benson and Bingham for a free legal consultation today.

The consequences from dog attacks can last a lifetime. While cuts and bruises heal, scars from bites linger for decades and those attacked can live with paralyzing fears of mans’ best friend. Just this December, 9-year old Alexis Gates was attacked in her Las Vegas neighborhood. The dog came running at the young girl and bit her savagely on her lip and leg. Even though she was rushed to University Hospital after the attack, Miss Gates still has to work at extensive physical therapy. Emergency Room visits, treatments, psychological counseling and physical therapy can be very expensive. If you have been injured in a Clark County dog attack and wish to be reimbursed for medical bills, pain and suffering and lost work, contact the personal injury attorneys at Benson and Bingham.

Established and 2003, Benson and Bingham quickly became one of the leading Las Vegas personal injury law firms. Our attorneys work with each of our clients to develop a strong trusting relationship.
