A bill is making its way through the Nevada Legislature that would allow for pre-trial discovery of video evidence in some cases where someone has been injured or died in an accident on the premises of store or hotel or casino property in the Las Vegas area. This bill is meant to lower the number of so called frivolous law suits, though some critics say it would do just the opposite. In plain language, this means that if you were hurt in an accident or someone you know was killed on the premises owned by someone else, for example a slip and fall on a hotel casino property in Southern Nevada, that if that property had video surveillance, it can be viewed by the slip and fall lawyer in Las Vegas prior to a law suit being filed.

Proponents of this legislation, state Senate Bill 111, contend that it would cut down on the number of frivolous law suits by letting lawyers look at this video evidence before they file a law suit. Currently, they have to take a potential client’s word for what happened before they take the case. Then the lawyer has to file the suit, and get the video through pre-trial discovery. If the video shows no negligence on the part of the property owner, the suit is thrown out. Allowing discovery of the video evidence would bypass this, proponents say. Some property owners, however, say that this would have the perverse effect of creating more law suits from lawyers who go on “fishing expeditions” to try to find video evidence of slip and fall accidents in Las Vegas, and then find the accident victim and file the law suit.

California Man Sues Las Vegas Metro For Injuries In Clark County Detention Center

Just weeks after the United States Justice Department provided guidelines on the policies of the Las Vegas Metro Police regarding the use of force when dealing with civilians, today it was announced that a California man is suing the Las Vegas police for injuries he received while he was in custody of the detention center in Clark County. The 36-year old Koi Pham, whose attorney released jail surveillance videos today when his case was announced, alleges he was violently thrown to the cement floor and now has intense headaches and requires plastic surgery to remove the scar on his forehead. CA Man Dies From 5-Storey LV Casino Fall

On New Year’s Eve, a 21-year old California man fell to his death from the Cosmopolitan Hotel. Found near the property’s tennis courts, police and medical examiners estimate the man fell from approximately 5 stories up. He was pronounced dead at 8:15am on January 1st. UC San Francisco recently released a report comparing the quality-of-care in nursing homes across the country. Las Vegas DUI Lands Man in Hospital, Woman in Jail

Yesterday, a 65-year old Las Vegas woman, Diana Chambers, was arrested on suspicion of Las Vegas DUI charges after striking a Nevada man, Shannon Newland, and his vehicle as he was filling the car with gasoline. NV Mines Cited For Workplace Safety

A recent inspection by the Mine Safety and Health Administration cited Nevada mining operation Yukon-Nevada Gold Corporation’s Jerritt Canyon Mill in Elko for multiple safety violations. The inspection was part of a nationwide inspection tour, itself a result of last summer’s explosion at Massey Energy’s Upper Big Branch Mine in West Virginia. The Jerritt Canyon Mill was cited for not properly disposing and storing combustible waste, barricading unsafe areas or adequately protecting workers from moving machine parts. If not fixed, these violations put workers at significant risk of personal injury including amputation injuries, wrongful death and brain damage.

In addition, the MHSA announced the Barrick Goldstrike’s Meikle Mine in Carlin was responsible for the death of two employees in an August 2010 accident. The two men, Daniel Noel and Joel “Ethan” Schorr, of Spring Creek, were killed when a clogged pipe struck them in a ventilation shaft.
