A bill is making its way through the Nevada Legislature that would allow for pre-trial discovery of video evidence in some cases where someone has been injured or died in an accident on the premises of store or hotel or casino property in the Las Vegas area. This bill is meant to lower the number of so called frivolous law suits, though some critics say it would do just the opposite. In plain language, this means that if you were hurt in an accident or someone you know was killed on the premises owned by someone else, for example a slip and fall on a hotel casino property in Southern Nevada, that if that property had video surveillance, it can be viewed by the slip and fall lawyer in Las Vegas prior to a law suit being filed.

Proponents of this legislation, state Senate Bill 111, contend that it would cut down on the number of frivolous law suits by letting lawyers look at this video evidence before they file a law suit. Currently, they have to take a potential client’s word for what happened before they take the case. Then the lawyer has to file the suit, and get the video through pre-trial discovery. If the video shows no negligence on the part of the property owner, the suit is thrown out. On New Year’s Eve, a 21-year old California man fell to his death from the Cosmopolitan Hotel.
