Las Vegas DUI Crash Results in Fatality

March 12th, 2013 No comments

Yet another fatal automobile accident has occurred in Las Vegas, and yet again, police believe the accident is due to a Las Vegas DUI. On Saturday evening, 23-year old Arturo Castillo was driving along North Rainbow Blvd. with a 15-year old boy from Las Vegas and another passenger when he lost control of his black SUV and crashed into a telephone pole. Police arriving at the scene performed a sobriety test on Mr. Castillo, which he subsequently failed. While the driver and one of the passengers in the SUV suffered minor injuries from the crash, unfortunately, the 15-year old boy who was also a passenger in the car was killed. The name of the minor who passed away in the crash has yet to be released, and will once his family has been notified. If you have been injured or had a relative killed in a Las Vegas automobile accident, Benson and Bingham can help you recover financially from the mishap.

This Southern Nevada DUI accident has brought to Las Vegas its 25th automobile related death of 2013. The Black SUV in the accident suffered serious damage in the crash – as well as the light pole.

Las Vegas Assemblyman Proposes Bill Banning Texting While Crossing The Street

Even though Nevada is seen by many as a libertarian paradise due to the Silver State’s embrace of legalized prostitution and its early acceptance of casino gambling, 2012’s rash of Las Vegas pedestrian deaths and 2013’s pace to beat 2012’s near record breaking numbers has state, county and city lawmakers and law enforcement officials proposing significant new laws designed to increase pedestrian safety. One of those provisions, a law to ban texting while walking received its first legislative hearing in the Nevada Assembly last week. The bill is patterned on the bill recently passed by the New Jersey town of Ft. Lee. If you or a relative has been hurt or killed in a Southern Nevada pedestrian accident, contact Benson and Bingham today.

The bill, as proposed by longtime Democratic Nevada Assemblyman Harvey Mumford, would fine people crossing the street while using their phones $100 for a second violation and $250 for a third and subsequent violation. The first time a person is ticketed for using their cell phone while crossing the street would be given a written warning. The New Jersey statute fines people $85 for breaking the law. A number of Democratic Assembly members asked significant questions during the hearing on the bill. Las Vegas Assemblywoman Heidi Swank wanted to know if the proposed law applied to those reading a book while walking. Transportation Committee Chairman Richard Carrillo wanted to know if he could be ticketed for just looking at his phone, possibly to answer an incoming call.

Benson and Bingham is the leading Las Vegas personal injury law firm, with significant experience in all types of personal injury law including Clark County pedestrian accidents, Las Vegas automobile accidents, Clark County wrongful death and even casino accidents outside the Silver State when the company’s corporate parent is based in Nevada. We also offer every one of our clients our exclusive happiness guarantee – if at the end of your case you are unhappy with your final invoice, we will work with you to develop a fee structure

1 Dead and Two Injured in Las Vegas Street Racing Accident

December 1st, 2012 No comments

As if Las Vegas hasn’t had enough traffic fatalities in 2012, a Las Vegas street racing accident on Friday night left one dead and two in critical condition when an Acura Integra struck a light pole on Maryland Pkwy around 9pm on Friday night. The men, all three aged 21 and from North Las Vegas were rushed to University Hospital after the accident. The death was listed as the 97th person who was killed in a traffic fatality in Vegas this year. If you have lost a loved one in a Las Vegas traffic fatality, contact Benson and Bingham today. We can help the surviving family members of a Las Vegas automobile death recover money for lost work, hospital bills and pain and suffering.

Street racing is a serious offense that can result in the loss of your license and the impounding of your automobile. In the last decade, 188 people were killed in California alone due to street racing. These are deaths that usually occur to young men with little or no criminal record or traffic citations. Alcohol is usually not involved in street racing deaths. Citations for illegal street racing can also carry significant penalties of up to $1000 and can even entail jail time of 3 months or more. If you have been ticketed for an illegal Las Vegas street race, 24hourticketpower.com can help you fight or fix your citation.

Benson and Bingham is Southern Nevada’s leading Las Vegas personal injury firm. Our licensed Nevada attorneys have extensive experience in Nevada automobile accidents, Las Vegas defective product injuries and even Nevada casino accidents. We develop strong long standing relationships with our clients that lead to significant personal recommendations and documented legal success. While no attorney can promise the successful outcome to your case, in a free legal consultation we will always give you our best judgment as to your case’s merit.

Syphilis Outbreak Concerns Las Vegas Adult Industry Workers

August 22nd, 2012 No comments

Las Vegas is a large city that is home to many industries, casino gaming and entertainment the most prominent. Other industries that make their home in the 31st largest city in the United States include mining & natural resources, construction, manufacturing, transportation. Las Vegas has also seen a growth in high tech business including Zappos.com, videogame publisher Electronic Arts, IBM, videogame developer Petroglyph and more. One industry that has seen significant growth in Las Vegas is pornography. Sin City’s large number of inexpensive hotel rooms and fewer legal restrictions than California have increased adult-video production to multiple scenes and full scale production in Southern Nevada each month. The rise in production also, unfortunately, can spread sexually transmitted diseases. These diseases can bring about significant Las Vegas workers compensation exposure issues for video production companies based in Las Vegas.

It has recently been reported that significant adult-video production in Las Vegas and Los Angeles has been shut down due to a syphilis scare that has potentially infected many male and female adult performers. Last week, five performers tested positive for the disease, and each have begun taking antibiotics to battle the STD. An untreated syphilis infection can damage the brain, heart, liver, eyes bones and even blood vessels. Those who have reached the late stage of syphilis infection have trouble walking, speaking, seeing and even grow demented. If you have been injured in a Las Vegas workplace accident, Benson and Bingham can represent you in your Southern Nevada workers compensation case.

The family owned Las Vegas personal injury law firm of Benson and Bingham has been working with Nevadans since 2003 to help them financially recover from Las Vegas pedestrian accidents, spine, brain and back injuries and even injuries from defective products sold in Nevada. We develop strong relationships with our clients as we work to help them recover money for lost work, medical bills and even pain and suffering.

Army Suicide Rate Continues To Increase Across Nevada and The United States

August 16th, 2012 No comments

Even though the Pentagon and Veteran’s Administration have significantly improved on post-traumatic stress disorder treatment and psychological treatment in general, twice as many active-duty soldiers committed suicide last month. In fact, throughout 2012, with fewer military personnel being deployed in Iraq and Afghanistan, suicides have continued to rise each month. In June 12 active-duty soldiers committed suicide, 16 in May and in July 26 took their own lives. The suicides have not been limited to active-duty soldiers – 12 Army Reservists committed suicide in June and July. Many of these soldiers have also suffered brain damage and other injuries from their active-duty service in the military. If you or someone you love has suffered from significant brain injury due to military service and you live in Nevada, Benson and Bingham can represent you in your Las Vegas personal injury case.

Only one of the potential suicides has actually been confirmed, however, the deaths continue to be investigated. The Army has also started to reach out to the individuals who have been impacted by suicide – their studies have shown that at a minimum ten others are affected negatively in the aftermath of a suicide.  Many suicides are often the result of significant psychological trauma from combat and can even arise from combat injuries to the brain. If you are the relative of a Las Vegas veteran who suffered from debilitating brain and spinal cord injury, contact Benson and Bingham to discuss your Nevada wrongful death inquiry.

Benson and Bingham were founded by cousins Joseph Benson, II Esq and Ben Bingham, Esq in 2003 to represent Nevadan’s in their personal injury claims and to help them financially recover from injuries. We represent soldiers from Hawthorne Army base in brain and spinal cord injury cases, casino slip and fall cases for companies based in Nevada and even Las Vegas defective product cases. We also represent tourists to Nevada from all over the world in vacation injury and wrongful death cases. We also offer a discount to military members.

Nevada Mining Firm Cited for Negligence After Workplace Death

Mines in Nevada and the United States are under the jurisdiction of the United States Mine Safety and Health Admin, and this week they released their report on an October, 2011 accident at the Newmont Mine in Carlin, NV. The MSHA’s report stated that the Elko, NV based company was negligent in failing to establish controls and procedures for the repair of trucks and other vehicles with toxic chemicals. The report also stated that the repair shop where vehicles were fixed was poorly ventilated. The Open pit at the South Area of the mine had over 1100 workers in the area. If you have a relative that has been killed in a Nevada workplace accident, contact Benson and Bingham for a free legal consultation today.

While fixing the tires on a mining truck, 21-year old Joe Ashdown was overcome by fumes from a chemical he was using. The area where the repair shop was located lacked adequate ventilation for use of the chemicals. In addition, Mr. Ashdown did not have a gas mask or other breathing apparatus necessary for using such harmful solvents. The company was also cited for assigning Mr. Ashdown to work on repairing the tires alone, without supervision and out of view from his co-workers. If you have lost a relative in a Las Vegas workplace wrongful death accident, Benson and Bingham can help you recover money spent on medical bills, lost work and pain and suffering.

Benson and Bingham is one of the leading Las Vegas personal injury law firms that focuses on Las Vegas personal injury, Clark County wrongful death and casino accidents across the United States. Our family owned company offers all of our clients our happiness guarantee. Ford Recalls Hundreds of 2013 Escapes Sold in Nevada

Today’s modern automobiles are extremely complicated. On a normal internal combustion engine, computers control the firing of spark plugs, the carburetors air to fuel ratio and even repeatedly checks the exhaust to ensure it meets pollution requirements. Today’s braking systems are designed to prevent hydroplaning and roll overs. With robotic brains that control nearly all the vital systems of today’s cars, it’s amazing that they continually work correctly and it’s even more amazing when simpler aspects of the car’s designs are the cause of defects. If you have been injured in a Las Vegas defective product case, contact Benson and Bingham for a free legal consultation.

This weekend, the Ford Motor Company announced that it was recalling over 10,000 Ford Escape SUVs. In the 2013 model of the very popular truck, the carpet and carpet padding have been shown to shift and prevent drivers from braking and accelerating the vehicle. In the wrong circumstance, this could cause the Ford Escape to crash. The recall covers nearly 8,300 SUVs sold in the United States and 2,000 in Canada. At this time, no accidents have been reported. The Ford Escapes were built between March 8th and June 7th. If you have been involved in a Southern Nevada accident with a defective Ford Escape, Benson and Bingham can help you to recover money to repair your vehicle, medical bills, lost work and pain and suffering.

Out family founded personal injury law firm was founded in 2003 to represent Southern Nevadans in defective product, casino injuries in the United States, Las Vegas slip and fall cases and more. In 2010 and 2011, our firm secured over $24,000,000 for our clients. Regardless of the outcome of your case, we will honor our Happiness Guarantee. When you get your bill, if you are unhappy with the charges, we will work with you to get a fee structure of which you will approve.

New Yorkers En Route From Nevada Based MGM Owned Foxwoods Casino Injured in I95 Car Accident

23 people traveling to New York City from Connecticut’s Foxwoods Casino were very lucky this morning. They were travelling by bus from the Leynard, Connecticut casino to Queens, NY on a shuttle bus chartered by Foxwoods. While travelling South on Interstate 95 the bus driver lost control near New Rochelle, and veered right and left and eventually struck a New Jersey barrier. While the bus accident occurred in New York State and the Casino was based in Connecticut, should the injured passengers decide to sue, the court jurisdiction could likely be in Nevada, where casino gaming company, MGM Resorts International is based. If you have been injured in a casino accident in Las Vegas or in a Las Vegas owned property, Benson and Bingham can represent you in your personal injury case in Nevada.

Benson and Bingham have represented thousands in Nevada casino injury cases, from slip and fall to malfunctioning elevators and escalators. Adam Pac Man Jones Ordered to Pay $11 Million for 2007 Las Vegas Strip Club Shooting

In February 2007, then NBA held their annual All-Star game at UNLV’s Thomas and Mack Center. Usually a college venue would be deemed too small for such a large NBA event, however, the league wanted to test Las Vegas’ ability to hold a large event such as their All-Star Game. While many who travelled to Southern Nevada for the NBA mid-season classic enjoyed their trips, some significant incidents brought Sin City’s ability to hold such a large event into question.

One of the major incidents from that weekend was a shooting at Minxx Gentlemen’s Club on Winn Road in Las Vegas. Adam Pac Man Jones, then a cornerback for the NFL’s Tennessee Titans, and hip-hop artist Nelly, in cooperation with management and a number of the club’s dancers began to “make it rain.” “Making it rain” is a visual effect where hundreds of one dollar bills are thrown into the air and the bills flutter as they fall to the ground. Management of the club then told the dancers to pick up the cash and that’s when Mr. Jones became enraged. The former West Virginia Mountaineer then assaulted one of the dancers and subsequently his entourage began to fight with the club’s security staff. Jones and his entourage left the club, but later, one individual, identified by the club’s manager, returned and began firing, striking two security guards, including former wrestler Tommy Urbanski. Mr. Urbanski was paralyzed from the shooting from the waist down. If you were the victim of a violent incident and would like to sue for Las Vegas personal injury, contact Benson and Bingham today for a free Las Vegas legal consultation.

This week, jurors returned an $11 million judgment against Pac-Man. Jones on behalf of the two security guards injured in the shooting, Mr. Urbanski and Aaron Cudworth. Mr. Urbanski is still paralyzed and in constant pain. If you have a Clark County personal injury case, Benson and Bingham can work with you and insurance companies to get you the money you deserve.

Benson and Bingham is a family focused law firm founded by cousins Ben Bingham and Joseph Benson to provide Southern Nevada personal injury representation. We represent clients in all types of personal injury cases, including casino slip and fall, automobile accidents and Clark County wrongful death.

Woman Injured in Hotel By Philly Phanatic, Contact Benson and Bingham for Nevada Hotel Injuries

The best mascot in Major League Baseball took the field for the first time in 1978, the Philly Phanatic. However in July 2010, the overly energetic mascot’s antics went too far. Susan Peirce was visiting the Golden Inn Hotel in Avalon, New Jersey for a wedding when, while she was sitting poolside, was picked up, along with her lounge chair and thrown into the pool by the large furry Phillies mascot. Ms. Peirce attests that she suffers from a herniated disc, injuries to her ligaments, tendons, muscles, bones, legs, body, arm, back, head, nerves and tissues. She also went into shock after being thrown into the pool. Her lawsuit is requesting money from the Philadelphia Phillies, the Philly Phanatic and the Golden Inn Hotel for medical costs, pain and suffering and lost work. While Cosmo, the Las Vegas 51s mascot, has never been accused of causing such an injury, people are injured in Nevada casinos and hotels everyday. If you have suffered a Nevada casino injury and wish to be reimbursed for lost work, pain and suffering and medical costs, contact Benson and Bingham today. Many casinos in the United States are headquartered in Nevada, so we can often represent you in your casino injury case even if it occurred outside of the Silver State.

The Philly Phanatic lawsuit has a significant complication. No one actually knows who was in the mascot costume that day. As stated above, the lawsuit names the Phillies, the hotel and Matt Mehler, Tom Burgoyne and any person who plays the role of the Philly Phanatic. It is clear who owns the Golden Inn Hotel, however. If you have suffered a Nevada hotel injury or injured in a hotel and casino whose corporate owners are located in Nevada, contact Benson and Bingham today for a free legal consultation.
