Deaths Near Mesquite, Nevada Virgin River Spur Wrongful Death Suit

A 3-year old girl drowned in the Virgin River, near Mesquite, NV on Tuesday. The child’s body was found in an irrigation canal owned by the Bunkerville Irrigation Company. The family of the girl was having a picnic near the river when the child’s grandmother saw the girl and two of her older cousins in danger of being swept away. The grandmother ran to the water and was able to pull out a 5-year old and a 4-year old but the young girl who died was out of her reach. The little girl’s body was likely sucked into a whirlpool created by the drainage ditch. Her death is similar to the death of 44-year old Joanna Hensley two years ago. Ms. Hensley’s survivors are now suing the Bunkerville Irrigation Company under Nevada wrongful death statutes. British National Scammed By Las Vegas Taxi Driver and Fitness Spa

The stabbing of a British tourist brought about a number of arrests and the possible closure of a local business, Red Devil Fitness & Spa. The business was marketed as a sex spa but it is alleged that the business actually made its money instead by duping customers to pay for the promise of sex, which never came. Businesses such as these, called “clip joints, usually enlist local cab drivers to bring them customers. The British tourist, Joseph Sheriff, 25, was stabbed multiple times, in the chest and head and nearly killed. Mr. Sheriff alleges that he discussed the possibility of paying for sex from both Hope Tello and Christine Nyholm. Mr. Sheriff alleges he was repeatedly asked for and paid money to both women and when he realized no sex would be forthcoming, grew enraged and threw a water bottle. A security guard then attacked Mr. Sheriff with a knife. Six people were arrested: 21-year old Brooke Dugan, 19-year old Lyeishia Godfrey, 23-year old Hope Telo, Christine Nyholm (age unkown),34-year old Nicole Cramer and 40-year old James Watkins. Las Vegas Metro Police Award $40,000 to Former Officer in Discrimination Claim

Southern Nevada police departments continue to be on the losing end of a number of lawsuits. Last month, over $300,000 was awarded to Adam Green, a man who was severely beaten by Henderson Police and Nevada Highway patrol during a highway traffic stop. Earlier this week, the Las Vegas Metro Police announced an award to a former officer for discriminatory practices due to the department’s restrictive facial hair policy. Retired Las Vegas Metro Police Officer, Ira Carter sued the department in 2010 regarding the department’s no facial hair policy. Mr. Carter suffered from a skin condition that made shaving very dangerous. The condition, called pseudofolliculitis barbae, causes scarring, cystic nodules and severe rashes after shaving. Mr. Carter had a waiver on the shaving policy for 14 years but in February 2009 he was reprimanded. Las Vegas Hepatitis Outbreak Spurs Changes To Nevada Safe Injection Practices

One individual, Michael Washington, who had received the drug through the use of reusable vials and eventually came down with hepatitis, was awarded $14 million.

It is estimated that nearly 300 lawsuits are pending stemming from the multi-use vials of Propofol sold and recommended by Israel-based Teva Pharmaceutical Industries and US based Baxter International. Of these 300 cases a number of verdicts have been announced. On October 10, three patients were awarded $162 million in punitive damages. The first case resulted in a verdict of $500 million. The propofol reuse case caused significant alarm and changes throughout the Nevada Medical Community. In the 76th Legislative session, Senate Bill 419 was proposed by the Nevada Senate Health and Human Services Committee. The bill initially required all medical professionals to take a Safe Injection Practices Continuing Medical Education Course as part of renewing their Nevada medical license and even fined medical professionals failed to take the course within an allotted time. These provisions were eventually amended out of the bill, instead requiring medical professionals to attest they are familiar with safe injection practices. Nurses Cleared In LV Infant Death – NV Hospital Liable?

Las Vegas Metro Police recently forwarded the results of their investigation into the 2010 death of 2-month-old Miowne Obote. CA Man Dies From 5-Storey LV Casino Fall

On New Year’s Eve, a 21-year old California man fell to his death from the Cosmopolitan Hotel. Found near the property’s tennis courts, police and medical examiners estimate the man fell from approximately 5 stories up. He was pronounced dead at 8:15am on January 1st.
