More Food Poisoning Cases — Las Vegas Next?

We are seeing a lot of issues with food in the legal news in Las Vegas recently, it seems. We’ve written several times before about the health department temporary closure and salmonella poisoning allegations at Firefly Restaurant off the Las Vegas Strip. In another case that could be of a related type, the State of California, per this article from the Las Vegas Sun, is suing two big retailers, Whole Foods and Trader Joe’s, for excessive amounts of lead in their ginger candies without proper warning labels for it. Were people to be sickened by this, it could be a type of product liability case in Clark County. Many food poisoning cases are like that, especially if they deal with tainted product from a distributor. Benson & Bingham are experienced attorneys in this complex legal tangle of law, call us today for a free consultation.

California requires lead over a certain level in consumables to labeled warning customers of the potential harms and dangers of lead. The concern is people unwittingly consuming high levels of lead and becoming ill. Lead poisoning can be among the most serious of potential effects on a person’s life, especially if the exposure is at a young age, according to the CDC. Even without a law like California’s, if you became sick because of lead poisoning you can file a law suit in Southern Nevada in certain circumstances. If you think you or a loved one may have suffered lead poisoning, especially unwitting or at the fault of another, call Benson & Bingham Attorneys at Law today to talk over your options without obligations.

California also named many other companies in their law suit, which was filed in the Superior Court of San Francisco by the attorney general of California. Names include well-known retailer Target, as well as several local markets and several food wholesalers or distributors, meaning the problem could easily be takes place in neighboring states like Nevada.

If you or a loved one has gotten sick, and believe another party may be at fault, Benson & Bingham will sit down with you and talk over your legal options with you free of charge. We’ve successfully litigated many premises or product liability cases before, and will be happy to tell you if you have a case, and what the next steps would be.

Vicious Las Vegas Pit Bull Attack Injures Two

March 23rd, 2013 No comments

While many advocates for pit bulls and other breeds considered dangerous, lament that public perception of the animals’ ferocity has less to do with the dog but instead how the animal has been treated, trained and raised. Unfortunately, a recent Las Vegas animal attack by a pit bull shows that those bit by any type of dog have injuries that need treatment, often hospitalization. With care of these injuries comes a multitude of bills – doctors’ bills, emergency room bills, prescription and over the counter medicine credit card charges and more. In addition, in the aftermath of a Las Vegas pit bull violence, the person bit may have lost a significant amount of pay from being out of work and may suffer severe emotional damage from the ferocity of the attack.

An early March Las Vegas dog bite incident injured two, when 60-year old Glen Coffer attempted to stop a fight between two dogs. As Mr. Coffer was trying to break off the fight, Daisy, a 6-year old pit bull turned to attack Mr. Coffer. 23-year old Gianna Silvagni was also injured in the attack when she tried to save Mr. Coffer from Daisy’s vicious attack. If you or a family member have been injured in a pit bull attack in Clark County, contact Benson and Bingham for a free legal consultation today.

Dangerous Las Vegas Intersection Has Seen No Improvements in Nearly A Year

March 17th, 2013 No comments

While Las Vegas area police departments and local, state and county health, transportation and safety agencies are working hard to reduce the number of Las Vegas pedestrian accidents in 2013, however, many Las Vegas residents are saying that safety upgrades are not moving fast enough. At one Northeast Valley intersection, local residents are wondering why improvements to the intersection of E. Lake Mead Blvd and N Sloan St. have not begun since local authorities were alerted to the dangerous intersection over nine months ago. Currently, the intersection has crosswalks and even pedestrian crossing caution signs, however, Las Vegas residents living in the neighborhood believe a flashing yellow light or even a traffic signal may be needed. If you or a member of your family has been injured or killed in a Clark County pedestrian accident, contact Benson and Bingham for a free legal consultation today.

Last June, while Las Vegas was in the midst of one of its most deadly years for Las Vegas pedestrian deaths, County Commissioner from Clark County, Tom Collins and the state’s Department of Transportation (NDOT) said the intersection needed to be reviewed for safety reasons. Unfortunately, nearly a year later, no improvements have been made to the intersection. An analysis of the situation has shown that NDOT and Clark County have debated over who has jurisdiction over the intersection. While many believe the intersection is dangerous, there have been no Clark County pedestrian deaths at the intersection in 2012 or 2013.

Southern Nevada pedestrian accidents happen every day. If you have been the victim of any type of Las Vegas automobile accident, Benson and Bingham can help you recover financially and recoup money spent on medical bills, for lost work and pain and suffering. More Companies Drawn Into Las Vegas Endoscopy Center Malpractice Case

February 24th, 2013 No comments

In 2007, the Endoscopy Center of Southern Nevada began ignoring safe injection practices and instead of using new needles for each injection and not reusing drug vials for multiple patients. By these supposed cost saving measures, The Endoscopy Center saved money anesthetizing patients but, unfortunately, pass on the hepatitis C virus to potentially 40,000 people. This case of Las Vegas medical malpractice was finally stopped in 2008 when the Endoscopy Center was closed by state and federal officials. The doctor and owner of the Endoscopy Center, Dr. Depak Desai, is currently awaiting trial on charges of Clark County medical malpractice. If you or a family member have been injured or killed, Benson and Bingham can represent you in your case.

In addition to the criminal charges that are pending Dr. Desai and the Endoscopy Clinic of Southern Nevada, a number of other firms have had significant legal issues due to the Southern Nevada medical malpractice. The Endoscopy Center of Southern Nevada reused bottles of Propofol when it injected customers with local anesthesia to prepare them for surgery. The manufacturer of the anesthesia, Teva Pharmaceuticals, manufactured vials of the drug with significantly more drug than was needed for an individual patient. Because of the large does bottles, the courts found the drug manufacturer libel, and the Israeli company settled over 120 cases for over $250 million.

This week, the Nevada Health Plan was sued over the Endoscopy Clinic unsafe injection case. Plaintiffs in the case allege that the health maintenance organization should have known about the unsafe use of needles and pharmaceuticals.

Benson and Bingham is one of Las Vegas’ leading personal injury law firms, having secured over $24 million in reimbursements for the victims they represent. Las Vegas Strip Shooting Results in the Wrongful Death of Three People

February 21st, 2013 No comments

An argument in a Las Vegas casino early this morning resulted in a shooting and a resulting Las Vegas automobile crash that killed three on Las Vegas Blvd at around 4:30 am today. The argument, which began at the valet station of the Aria Hotel, escalated on Las Vegas Blvd. when an occupant of a Range Rover shot into a silver Maserati at the intersection of  Flamingo Rd. and Las Vegas Blvd. After the shooting, the Maserati ran the red light in the intersection and slammed into a taxi being driven by Michael Boldon. The three people killed in the Las Vegas wrongful death accident were rapper Kenneth Cherry, who went by the stage name of Kenny Clutch, Michael Boldon, the cab driver and an additional unnamed passenger in the taxi.

The Las Vegas automobile accident of the Maserati striking the taxi caused a significant explosion that burned both occupants of the cab beyond recognition. The force of the Italian sports car striking the taxi also caused other vehicles in the intersection to be damaged. Las Vegas area police agencies have continued an exhaustive search for the Range Rover seen to be at the heart of the incident. The truck is known to have paper dealer license plates and large rims. A census of casino and taxi security cameras show the imported black SUV heading along Koval Lane in the time after the shooting. This was captured by the Venetian Hotel’s security cameras. The taxi company involved in the Clark County wrongful death attack, Desert Cab, had no vehicles in service the rest of the day.
