Slip and Fall Accidents in Las Vegas — Get the Video Before the Lawsuit?

A bill is making its way through the Nevada Legislature that would allow for pre-trial discovery of video evidence in some cases where someone has been injured or died in an accident on the premises of store or hotel or casino property in the Las Vegas area. This bill is meant to lower the number of so called frivolous law suits, though some critics say it would do just the opposite. In plain language, this means that if you were hurt in an accident or someone you know was killed on the premises owned by someone else, for example a slip and fall on a hotel casino property in Southern Nevada, that if that property had video surveillance, it can be viewed by the slip and fall lawyer in Las Vegas prior to a law suit being filed.

Proponents of this legislation, state Senate Bill 111, contend that it would cut down on the number of frivolous law suits by letting lawyers look at this video evidence before they file a law suit. Currently, they have to take a potential client’s word for what happened before they take the case. Then the lawyer has to file the suit, and get the video through pre-trial discovery. If the video shows no negligence on the part of the property owner, the suit is thrown out. But, both the property owner and the lawyer have already spent hundreds if not thousands of dollars on this lawsuit that goes nowhere. Allowing discovery of the video evidence would bypass this, proponents say. Some property owners, however, say that this would have the perverse effect of creating more law suits from lawyers who go on “fishing expeditions” to try to find video evidence of slip and fall accidents in Las Vegas, and then find the accident victim and file the law suit.

Vehicle Crashes into Las Vegas Strip-area Restaurant

A Lexus recently smashed into a Las Vegas eatery, injuring ten patrons and staff. The car accident occurred in a restaurant just off the Las Vegas strip. The sedan, driving eastbound on Sahara Avenue, spun after sliding into the median, bashing into two vehicles before parking itself inside the restaurant, according to other people who were at the scene. As if this wasn’t enough unexpectedness for frightened, excited, injured, or confused patrons of the establishment, The Egg & I, the driver and a passenger of the Lexus sedan attempted to escape the scene by jumping out of the car and trying to make a getaway. Several quick-thinking and civic-minded customers grabbed the would-be perpetrators of this remarkable almost-hit-and-run accident near Southern Nevada’s world-famous Las Vegas Strip. The ten individuals injured in this stunning vehicle accident in Las Vegas were taken to UMC as well as Sunrise Hospital for treatment, according to fire officials, some of them with very serious injuries. If you’re ever injured in an accident, vehicle or otherwise (whether it’s as sensational an accident as this or just an “ordinary” injury accident), you need the legal expertise of Benson & and Bingham attorneys at law. Reports indicate that as many as four people, possibly including a boy as young as 13 years old, may have been stuck below the vehicle in this Southern Nevada crash where it came to a stop inside the restaurant. Apparently the Lexus came to rest propped up on some furniture inside the establishment, preventing it from seriously injuring some people who attempted to take shelter just below where the vehicle eventually came to a stop. Thankfully no one was killed in the accident, though plenty of people were injured. People who are in this type of situation – the victims of a terrible accident – need the best representation to make sure they can pay their medical bills, afford to take the time off of work to heal, and be compensated for their pain and suffering. Benson and Bingham is the firm that savvy accident victims choose to make sure that they are covered, and justly compensated for being in such a horrible situation at no fault of their own. Benson & Bingham is a law firm where you come first. They pride themselves on their service: not only on the legal service of making sure you’re covered if you’re injured, but also on their service in terms of how they treat you as a person, and how you feel as a client. Benson & Bingham has been serving clients since 2003, and has secured as much as $24,000,000 over two years for their clients since them.

Vicious Las Vegas Pit Bull Attack Injures Two

March 23rd, 2013 No comments

While many advocates for pit bulls and other breeds considered dangerous, lament that public perception of the animals’ ferocity has less to do with the dog but instead how the animal has been treated, trained and raised. Unfortunately, a recent Las Vegas animal attack by a pit bull shows that those bit by any type of dog have injuries that need treatment, often hospitalization. With care of these injuries comes a multitude of bills – doctors’ bills, emergency room bills, prescription and over the counter medicine credit card charges and more. In addition, in the aftermath of a Las Vegas pit bull violence, the person bit may have lost a significant amount of pay from being out of work and may suffer severe emotional damage from the ferocity of the attack.

An early March Las Vegas dog bite incident injured two, when 60-year old Glen Coffer attempted to stop a fight between two dogs. As Mr. Coffer was trying to break off the fight, Daisy, a 6-year old pit bull turned to attack Mr. Coffer. 23-year old Gianna Silvagni was also injured in the attack when she tried to save Mr. Coffer from Daisy’s vicious attack. If you or a family member have been injured in a pit bull attack in Clark County, contact Benson and Bingham for a free legal consultation today.

11-Year Old Girl Killed In Las Vegas Sledding Accident On Mount Charleston

January 3rd, 2013 No comments

The start of the year brought terrible tragedy to the Lara family of Southern Nevada that had gone to Mt. Charleston for a sledding outing that resulted in the death of their 11-year old girl, Vanesa.  Lara was sledding with her family when she and another passenger on her sled crashed into a fence that had been installed in October to prevent those sledding from entering an area of the park. Vanesa Lara was killed when she and a friend on a sled crashed into the metal barrier. The girl died from an aortic and hemopericardium laceration. The injury, caused by the blunt trauma from hitting the fence, resulted in the sac around the young girl’s heart and the primary artery leading to the organ rupturing. If you or a family member has been hurt or killed in a Nevada winter and ski accident, contact Benson and Bingham today.

Usually, winter accidents in Nevada happen in the Northern areas of the Silver State, however, icy roads resulting from rare below freezing desert nights and ski areas like Mt. Charleston make Las Vegas winter and ski accidents a possibility. Ice and snow can also hide barriers and obstacles that can cause blunt injury and slip and fall accidents. When participating in winter sports, it is important for everyone to scout the location for any hazards and to double check all equipment is free of wear and tare.

Benson and Bingham, one of Las Vegas’ leading personal injury law firms, represents people injured through no fault of their own in Las Vegas, Reno and across Nevada. We have significant experience with Las Vegas automobile injuries, Nevada wrongful death accidents , Clark County winter sports accidents and more. Our Nevada licensed personal injury attorneys always strive to create strong relationships with those they represent. In fact, in 2010 and 2011, we secured over $24,000,000 in injury awards for our clients.

Fire At Las Vegas Treasure Island Casino Injures 14

Today’s modern Las Vegas casinos are large, complicated almost mini-cities where a person could live for days, weeks and possibly even years without leaving. The casinos have nearly all types of restaurants, shopping centers, entertainment venues, movie theaters and obviously hotel rooms, suites and gaming tables. These mini-metropolises require complicated ventilation systems, coordinated mega-deliveries of food stuffs and detailed schedules for employees of many ethnicities, levels of education and skills. With this level of complexity, it is inevitable that something can go wrong and cause the injury or death of a patron or employee. If you have been injured or killed in a Las Vegas casino accident, the personal injury attorneys at Benson and Bingham can help you to recover money spent on healthcare, lost to missing work or even for pain and suffering.

This morning, one of the complicated systems that runs the hotel broke down and injured at least 14 people. At the Treasure Island Hotel and Casino this morning around 9 a.m. one of the rooftop air conditioning units caught fire. As 90 firefighters on the scene worked to put out the flames, smoke from the fires worked its way through the air conditioning ventilation system flooding floors 24 through 36. Much of the hotel was evacuated. If you have been injured in a Nevada hotel injury, Benson and Bingham have the personal injury attorneys and contact in the Nevada court system to represent you.

While Benson and Bingham can represent you in your Las Vegas casino injury case, our attorneys can also represent you if you are injured in a casino outside of Nevada that is managed or owned by a Las Vegas company. In 2010 and 2011, our family owned firm secured over $24,000,000 in personal injury awards for our clients. While no law firm will promise the successful outcome of your case, Benson and Bingham offers all of our customers our exclusive happiness guarantee. When you get your final bill, should you be unhappy with the total, we will work with you to develop a fee structure that you find amenable.

Ford Recalls Hundreds of 2013 Escapes Sold in Nevada

Today’s modern automobiles are extremely complicated. On a normal internal combustion engine, computers control the firing of spark plugs, the carburetors air to fuel ratio and even repeatedly checks the exhaust to ensure it meets pollution requirements. Today’s braking systems are designed to prevent hydroplaning and roll overs. With robotic brains that control nearly all the vital systems of today’s cars, it’s amazing that they continually work correctly and it’s even more amazing when simpler aspects of the car’s designs are the cause of defects. If you have been injured in a Las Vegas defective product case, contact Benson and Bingham for a free legal consultation.

This weekend, the Ford Motor Company announced that it was recalling over 10,000 Ford Escape SUVs. In the 2013 model of the very popular truck, the carpet and carpet padding have been shown to shift and prevent drivers from braking and accelerating the vehicle. In the wrong circumstance, this could cause the Ford Escape to crash. The recall covers nearly 8,300 SUVs sold in the United States and 2,000 in Canada. At this time, no accidents have been reported. The Ford Escapes were built between March 8th and June 7th. If you have been involved in a Southern Nevada accident with a defective Ford Escape, Benson and Bingham can help you to recover money to repair your vehicle, medical bills, lost work and pain and suffering.

Out family founded personal injury law firm was founded in 2003 to represent Southern Nevadans in defective product, casino injuries in the United States, Las Vegas slip and fall cases and more. In 2010 and 2011, our firm secured over $24,000,000 for our clients. Regardless of the outcome of your case, we will honor our Happiness Guarantee. When you get your bill, if you are unhappy with the charges, we will work with you to get a fee structure of which you will approve.

NTSB Assigns Blame In December Las Vegas Tourist Helicopter Crash

Last year, on December 7th, a Las Vegas sightseeing helicopter carrying five people, the pilot, two from Kansas celebrating their twenty-fifth wedding anniversary and two honeymooners from India crashed just sixteen miles from Las Vegas. The two couples were on vacation, and had paid tour operator, Sundance Helicopters, to take them on a helicopter tour of the Hoover Dam. Emergency personnel rushed to the scene, but unfortunately, there were no survivors from the crash. The company had also been involved in 2003 when a helicopter taking tourists on a tour of the Grand Canyon crashed after its rotors struck the walls of the national monument. If you have been injured or had a relative killed in a Las Vegas vacation accident or crash, contact Benson and Bingham today for a free legal consultation.

The NTSB, which investigates tragic air accidents across the United States, has issued its report on the December helicopter accident that resulted in the tragic deaths of the two couples. The board states that certain steering mechanisms and other small parts including bolts and screws were not found at the scene of the crash. However, the parts of the helicopter that are normally attached to the steering mechanism and bolts were found, and there is little chance the parts would be missing even after a catastrophic accident. Investigators are assuming the bolts and other small parts were secured before the helicopter took flight, were installed incorrectly and fell off during flight. These findings are consistent with the Eurocopter AS350’s reported climbs, dives and turns during the crash. If you have lost a relative due to a Hoover Dam helicopter crash, and wish to recover money for lost work, travel costs, hospital costs and pain and suffering, contact Benson and Bingham today.

Benson and Bingham is a leading Las Vegas personal injury law firm that represents people injured in casinos owned or run by Las Vegas gaming companies, those hurt during Las Vegas vacations and dangerous or defective product cases.

With Las Vegas’ Hot Desert Summers, Tire Separation is a Key Concern

Las Vegas’ intense summer heat can create dangerous conditions on Southern Nevada highways. One of the biggest dangers of Las Vegas’ intense desert summer heat is tire separation due to older and faulty tires. As a vehicle gets older and tires deflate, the walls of the tires can often weaken. Most people just add additional air to their tire and never head to a service station, tire installer or even vehicle dealer to have their tires inspected. Las Vegas’s summer heat also adds to tire separation damage. The hotter a tire gets in normal driving conditions, the more chance it has of blowing out and the tread separating. The searing heat of Clark County summer raises the temperature of highway asphalt, increasing the danger of a catastrophic high-speed Clark County tire blow out accident. If you have been a victim of a Las Vegas tire separation accident, which resulted in a Las Vegas personal injury incident, contact the personal injury attorneys of Benson and Bingham. Our Southern Nevada Personal Injury attorneys have the experience to get you reimbursement from car insurance companies for lost work, pain and suffering and hospital bills.

There are other things you can do to ensure you are not the victim of a Southern Nevada tire blowout accident. Make sure your tires are properly inflated. Tires can fail when they are either under inflated or over inflated. Get your tires checked annually for wear and tear. Old tires are often the causes of catastrophic Las Vegas tire blowout accidents. Finally, when driving, always maintain and safe speed and keep an eye out for potholes and other obstructions in the road way. Hitting a pothole at high speed can often damage the tire, which could subsequently lead to a catastrophic tire blow out and resulting accident. If you have been involved in any type of Las Vegas automobile accident and were injured, contact Benson and Bingham today to discuss your case in a free legal consultation.

Florida Pedestrian Injured After Las Vegas Electric Daisy Carnival

While the Electric Daisy Carnival in Las Vegas this year had a smaller attendance and lower incidences of DUI, drug and other felony arrests at least 16 people were rushed to the hospital during the 4-day Las Vegas event. The Electric Daisy Carnival came to Las Vegas in 2011 due to the ecstasy overdose death of a 15-year old girl at the 2010 Electric Daisy Carnival then held in Los Angeles. While this year has not had any drug overdose fatalities, a 31-year old pedestrian from Florida was critically injured when he was run down by a Ford Pickup leaving the event from Las Vegas Motor Speedway’s Gate 6. While the pedestrian who was injured in the accident was intoxicated and seen to be at fault at this time, if you have been injured in a Las Vegas pedestrian accident with an automobile, contact Benson and Bingham for a free legal consultation from one of our leading Las Vegas personal injury attorneys.

Since 2010, the organizers of the Electric Daisy Carnival have worked hard to reduce security and safety concerns associated with the event. This year’s event had fewer DUI arrests and medical calls, which can be attested to low temperatures last weekend and the closing of the carnival on Saturday evening due to wind safety concerns. However, there was one traffic accident resulting from the Las Vegas rave event last year and there were five traffic accidents in 2012. If you were injured in a Clark County pedestrian accident and would like to recover money for lost work, pain and suffering and medical bills, the Las Vegas personal injury attorneys at Benson and Bingham can help you. Our law firm has been in business since 2003 helping Southern Nevadans get what they deserve after Southern Nevada pedestrian accidents, Las Vegas brain injury accidents or Nevada casino slip and fall incidents.
