Las Vegas Casino Knife Assault Puts Man In Hospital and Two Behind Bars

February 20th, 2013 No comments

Las Vegas can be a great place for a vacation, but for married couple Eric Miller and Diane Androvich on early Sunday morning it nearly turned tragic. The couple were returning to their room in the Mandalay Bay Hotel when they encountered 25-year old Trent Wilcox and 23-year old Carlos Heredia. According to reports from Mr. Miller and Ms. Androvich, Mr. Wilcox and Mr. Heredia were visibly intoxicated when they entered the elevator and were behaving very aggressively. The Las Vegas assault and battery incident occurred around 2am on Sunday morning. If you have been the victim of a Southern Nevada assault, contact Benson and Bingham today for a free legal consultation.

Mr. Wilcox and Mr. Heredia were arraigned today on the charges and are each being held on $250,000 bail. The assault was stopped when Ms. Androvich hit the panic button on the elevator as the two men attacked her husband, from behind and with a knife. The whole assault seems to have stemmed from an argument between the four individuals and escalated after Mr. Miller and his wife exited the elevator on the hotel’s 31st floor. The fight escalated when Mr. Wilcox grabbed Mr. Miller in a choke hold and Mr. Heredia began stabling Mr. Miller. In the attack, Mr. Wilcox was also stabbed by Mr. Heredia’s knife. Clark County assaults can happen to anyone at any time, if you or a family member has been injured or killed in a Las Vegas assault, Benson and Bingham can help you recover financially from the attack with a settlement or award for hospital bills, pain and suffering and even lost work.

68-Year Old Woman Accuses Las Vegas Doctor of Sexual Assault During Exam

January 29th, 2013 No comments

There are all types of assault cases that are brought in front of Clark County Courts. Las Vegas’ casinos, clubs, bars and millions of tourists they bring often also bring fights, brawls and other types of Las Vegas assaults. Other types of assaults include sexual assaults. These also unfortunately can happen when people have been drinking and partying in Las Vegas clubs and casinos. Late last year, another type of assault was brought to the attention of authorities at the end of 2012 when a doctor at St. Rose Hospital was accused of sexually assaulting a 68-year old patient. The doctor, Mane Shah, has been placed on leave by the hospital and is being investigated by Las Vegas police. If you have been the victim of a Las Vegas assault attack, contact Benson and Bingham for a free legal consultation today.

After the alleged sexual assault, hospital employees preserved the rubber examination gloves used by Dr. Shah. Police are investigating the assault and are pointing to an attempted faked polygraph test as evidence. Dr. Shah’s attorney decries polygraphs as junk science and noted that lie detector tests are not court admissible. Dr. Shah has posted a $25,000 bond, however, is not practicing medicine at this time. A court hearing on the Clark County assault case is currently set for early April.

Las Vegas was founded in 2003 by cousins Joseph Benson and Benjamin Bingham with the goal of helping those hurt through no fault of their own recover financially from their accidents. Our licensed Nevada personal injury attorneys have significant experience with Southern Nevada assault and battery cases, Las Vegas pedestrian accidents, and even casino accidents outside of the Silver State when the company’s corporate headquarters is based in Nevada. Our attorneys pride themselves on the strong relationships we build with our clients and it is these relationships that enabled us to recoup over $24,000,000 for our customers in 2010 and 2011.

December 30th, 2012 No comments

A 24-year old Salinas, CA man is awaiting extradition to Las Vegas on charges of a sexual assault on a 22-year old woman on the Las Vegas strip on September 1st this year. The woman, whose name has not been released by Las Vegas police, was walking to her hotel on Las Vegas Blvd when it is alleged she was attacked by Mr. Rosendo Lopez. Metro police investigators zeroed in on Mr. Lopez as the chief suspect in the Las Vegas assault by examining security vides from Las Vegas hotels around the time of the assault. If you have been the victim of assault and battery in Las Vegas, contact Benson and Bingham for a free personal injury legal consultation today.

Moments after the alleged assault, security personnel from one of the hotels on the Las Vegas strip found the woman running barefoot and screaming for help. Las Vegas strip hotels, in the interest of helping the woman assaulted, provided local police with security footage loitering in the area of the attack moments before it is alleged to have happened and fleeing the vicinity of the attack at the same time the assaulted 22-year-old woman was found by hotel security. At this time, it is unknown as to whether the woman will sue Mr. Lopez for assault and battery in Nevada.

Two Las Vegas Casino Assaults Put Casino Safety In Question

December 24th, 2012 No comments

Two especially violent injury incidents at Las Vegas casinos the past few weeks have shown that no matter how many safety features are installed in the gambling palaces, Las Vegas casino injuries can still happen every day.

On  Saturday the 22nd, two blackjack dealers at the Bellagio got in an argument while working in the casino pit. As the argument escalated, one of the Bellagio employees, Brenda Wilson, aged 50, stabbed her co-worker in the face. After the incident, the stabbed woman was rushed to a local hospital and Ms. Wilson was arrested on charges of Las Vegas assault and battery. If you have been injured in a Clark County casino assault, contact Benson and Bingham for a free legal consultation today.

In another Las Vegas casino assault, one woman and one man are dead in an apparent murder suicide. On Friday, December 14th, 31-year old Edward Brandt, from Lake Forest, Il, shot and killed 30-year old Jessica Kenny while she was working at a concierge desk in the Las Vegas Excalibur. Ms. Kenny did not work for the Excalibur hotel, instead was employed by one of the casino’s partners, Vegas.com, a travel website. Ms. Kenny and Mr. Brandt may have been romantically involved as far back as 2009 but are not known to have dated recently. After shooting and killing Ms. Kenny, Mr. Brandt turned the gun on himself and died at the scene.

The family owned Las Vegas personal injury law firm, Benson and Bingham, represents people hurt in Las Vegas injury accidents. Video of Las Vegas Bullying Incident Spurs Assault and Battery Charges For Two Teens

December 21st, 2012 No comments

The arrest in late November of two teen boys for bullying another teen brought to light the legal implications of the behavior of kids and teens across the world. Authorities were alerted to this incident of Las Vegas assault and battery when a third teen involved posted a video of the incident recorded on his iPad. All four students attend Middle School in Las Vegas at Roy Martin. Youtube statistics show the video has been viewed 0ver 50,000 times. If you or your child has been a victim of a Las Vegas bullying assault, Benson and Bingham can help you recover financially from the physically and traumatic incident.

The video brings to light the sub-culture of teen boys and bullying and how two boys, in this instance 13-year old and 15-year old brothers, both attacked another innocent teen boy. At the start of the video, the boys are talking about the supposed 13-year old’s t-shirt when the seemingly youngest of the group walks around one of the other teens and punches him in the right side of the face. The teen who was punched, who some believe is a special needs student, apologizes and walks away, when he is then attacked by the larger of the two attacking teenagers. The teens involved state that the attack happened because the bullied teen showed up to the brother’s home uninvited. The mother of the two teens has apologized for the incident and assures authorities and the bullied teen that the boys will be punished.

Professional Poker Player Injured in Las Vegas Casino Attack

Las Vegas is a great travel destination. Our city boasts some of the nicest hotels, casinos, pools, nightclubs in the world. People travel here to enjoy our outstanding weather, to gamble and to party with abandon. Unfortunately, however, sometimes the good times in Vegas can come to a violent end. After the UK’s Sam Trickett came in second in the recent World Series of Poker Tourney held Las Vegas Rio casino and hotel, he and his girlfriend were attacked by six men who he says also spit on his girlfriend, Natasha Sandhu. While obviously Mr. Trickett’s attackers bear responsibility for the Southern Nevada personal injury, the Rio Hotel and Casino could also be held responsible for the Las Vegas casino injury.

Mr. Trickett bought into the World Series of Poker Tour event with $1 million. He eventually came in second in the tournament and won $10.1 million! The English former plumber doesn’t believe the attack was a mugging for his poker winnings, instead, he believes it was a random act of violence that can occur when people have been over served. Nevada law requires bartenders and venues where alcohol are served to not continue to serve visibly intoxicated patrons. If you have been victim of an attack due to Clark County casino negligence, contact Benson and Bingham for a free legal consultation.

Benson and Bingham has been working in Southern Nevada to help those injured in Las Vegas casino accidents, wrongful death, brain injuries and more. Our firm is family owned, founded in 2003 by cousins Ben Bingham and Joseph Benson. The success of our firm can be tied to the personal relationships we build with all of our clients. This enabled us to secure $24,000,000 for our clients in 2011 and 2012. After your case has been completed, should you not be happy with your final bill, we will gladly work with you to find a fee structure you agree with.

NV Coal Energy Plants Accused of Poisonoing Neighbors

February 1st, 2012 No comments

As fuel costs rise, NV Energy and other utility companies continue to struggle with providing low-cost dependable energy to their many ratepayers. Many states and utilities are looking to nuclear power to meet the needs of their customers, but for desert states like Nevada the significant water needs of this form of power rules out the smashing of plutonium molecules to generate power – even though much of the nuclear fissionable materials mined in this country come from the Silver State. While the Federal Government funds alternative energy technologies in an effort to reduce our nation’s dependence on fossil fuels, more and more utilities like NV Energy increase their reliance of coal power.

Coal is one of the most abundant fossil fuels in the United States. Its significant subsidies from the federal government ensure the continued mining and burning of coal to power and heat Nevada’s and the country’s homes and businesses. However, the burning of coal has costs associated with it that are often not computed when determining price per kilowatt hour. While many coal plants have combustion emissions systems that reduce the toxins blown into the atmosphere, the burning of coal releases carbon dioxide, sulfur, nitrogen and other carcinogenic compounds. If you or a family member have been poisoned by a nearby Nevada coal-power plant, and want remuneration for health care costs, lost work and suffering, contact Benson and Bingham for a free consultation today.

The Sierra Club in Nevada recently called for the Reid Gardner Coal Plant to be shut down after it was found that all the members of the Hernandez family, who live just 500 yards from the plant, were suffering from respiratory illnesses. If you or your family have been sickened by the burning of fossil fuels or other industrial pollutants in Nevada, contact Benson and Bingham for a free consultation today.

Benson and Bingham Attorneys at Law work every day to help their clients and their families survive catastrophic injuries and wrongful deaths. While we cannot promise to win your case, the satisfaction of our clients is what gets us up every morning. Please contact Benson and Bingham for a free consultation today.

Nevada Personal Injury Lawsuit Against Ben Roethlisberger Settled

January 21st, 2012 No comments

Today it was announced that the allegation of rape from July 2008 by a South Lake Tahoe VIP Casino Hostess against Ben Roethlisberger has been settled out of court. The terms of the settlement were not announced.

It is alleged that in July 2008 a South Lake Tahoe Casino hostess went to the room of a guest, responding to a complaint that his TV was not working properly. Excited to meet the famous guest, two-time football championship quarterback, Ben Roethlisberger, the un-named casino host rushed to the suite. At this point the events of that evening are in dispute.

The South Lake Tahoe VIP Casino Hostess alleges that when she went to Mr. Roethlisberger’s hotel suite, she was raped. In court papers, the Pittsburgh Steelers quarterback admitted to sexual contact with the woman but claims anything that happened between the two was consensual.

In 2009, the raped South Lake Tahoe VIP Casino Hostess filed a personal injury lawsuit against the quarterback and her employer, Harrah’s Casino, who she alleged had tried to cover up the assault.

While much of the court proceedings on the case had been to discuss change of venue – originally set for Reno, the defendant wanted the case moved to Carson City, due to the close proximity of this location to where the alleged South Lake Tahoe assault occurred.

If you have been the victim of a Las Vegas casino assault, contact the personal injury attorneys at Benson and Bingham for a free consultation today.

The VIP Casino hostess who alleged the incident did not file criminal charges in the case.

Roethlisberger was initially suspended by the National Football League for the incident for six games at the start of the 2010 season. The suspension was reduced to 4 games after the contrite Super Bowl winning quarterback adhered to a program prescribed by the NFL. Since the suspension, Ben Roethlisberger has not been accused publicly of any wrong doing.

Benson and Bingham have significant experience fighting to ensure those, through no fault of their own, a injured at work, home or in a public place receive the compensation they deserve for medical bills, lost work and pain and suffering. While no one can promise your case will be successful, we pride ourselves on working closely with our clients to ensure their satisfaction.

Las Vegas, Nevada Domestic Violence Victims Can Seek Additional Remedies

January 17th, 2012 No comments

An analysis of 2009 FBI  statistics by the DC Violence Policy Center showed Nevada as having the highest rates of domestic violence in the country. With a rate of 2.7 homicides per 100,000, Nevada outpaced even Alabama’s 2.6 per 100,000. While the FBI downplays comparisons between different states’ crime rates, regardless, the news was sobering for Nevada residents and lawmakers.

In response to Nevada’s high domestic violence rates, Las Vegas Metro Police began referring domestic violence victims to SafeNest. SafeNest provides the victims of domestic abuse with helplines, group counseling, transportation assistance and even court advocacy.

This news has brought a decline in Nevada domestic violence incidents. In late December, when police reported to the North Las Vegas residence of Shaunna and Douglas Jones, Ms. Jones declined treatment for facial, hand and head injuries. Ms. Jones was later found dead by family on January 13th by family. Her cause of death was determined to be head trauma by Clark County medical examiners. Further examination has led investigators to determine that the abuse suffered by Ms. Jones in December was the cause of Ms. Jones January death. Bail has been set for Mr. Jones of $1,000,000.

While many domestic violence incidents go unreported, many times Nevada domestic violence victims or their surviving family members of can and do sue for medical bills, lost work and other expenses. Significant medical injuries often call for experienced representation, so if you or a family member has experienced head trauma as a result of significant domestic abuse, contact us for a free legal consultation today.
