Nevada Supreme Court Enlists Mediator In Pac Man Jones Shooting Case

August 30th, 2012 No comments

In 2007, the NBA held their All-Star Game in Las Vegas for the first time. The game was unique because it wasn’t being held in a city that currently had an NBA franchise, but instead was being held in America’s leisure capital. However, violence that weekend marred what could have been a signature event for the largest city in the Silver State. Two shootings occurred in the late hours of Sunday Evening/Monday morning. One occurred in the parking lot of the MGM grand, yet the injured man failed to press charges. The other shooting occurred at a Las Vegas strip club called Minxx. Three people were injured in the shooting, and one, former wrestler Tomas Urbanski had his spine severed, causing him to lose the use of his legs. If you have been involved in a Las Vegas spinal cord injury accident, Benson and Bingham can represent you in your personal injury case.

The shooting occurred when professional football running back Adam Pac Man Jones decided to make it rain in the club by throwing a significant amount of money in the air. After the money had fallen to the ground, dancers at the club began to pick up the money. Mr. Jones feared the dancers were intending to keep the money and allegedly grabbed the dancers hair. After slamming the dancer’s head on the stage, Mr. Jones was confronted by a club security guard and was asked to leave the premises. At the same time, Chris Mitchell, who worked for the club, left the premises with a trash bag full of approximately $81,000 and two expensive Beitling watches. As patrons were leaving the club after the incident, a person suspected of belonging to Mr. Jones entourage fired into the crowd, injuring three, including Mr. Urbanski. If you have suffered a significant back injury in Southern Nevada, Benson and Bingham can represent you in your Southern Nevada personal injury case.

This year, Mr. Urbanski was awarded $13 million in his personal injury lawsuit against Mr. Jones. Alleging his paralysis in the Clark County shooting was due to the NFL’s negligence in controlling Mr. Jones behavior, Mr. Urbanksi also filed suit against the National Football League. The case was originally thrown out of court in 2008 but an August 21st appeal by Mr. Urbanski led the Nevada Supreme Court to appoint a mediator in the case on August 30th.

NJ Motorcycle Accident Could Have Precedent Over Nevada Cell-Phone Use While Driving Laws

August 29th, 2012 No comments

A New Jersey husband and wife recently settled on their motorcycle accident case where both of them lost a leg. The couple received $500,000 as compensation for the loss of their individual legs. This represented the maximum payout from the driver’s insurance policy. Motorcycle accidents in any state can cause significant personal injury and even death. If you have been injured in a Las Vegas motorcycle crash, Benson and Bingham have the experience negotiating with insurance companies to ensure you are able to secure the best possible settlement.

The Dover, New Jersey couple, who have recently moved to Florida in search of work, also sued Shannon Colonna, the girlfriend of 19-year old Kyle Best. Mr. Best was reading text message from Ms. Colonna when the accident occurred. Even though Ms. Colonna had no idea Mr. Best was driving, the injured couple, Linda and David Kubert’s attorney states that Best’s failure to use due care was directly due to Ms. Colonna’s text message. Mr. Best plead to the use of a mobile phone while driving. Had Mr. Best hit the Kubert’s while they were riding in a car instead of a motorcycle, the injuries could have been significantly less severe. That’s why if you are involved in a Southern Nevada motorcycle accident, our attorneys can help you recover money for pain and suffering, lost work and medical bills.

The passage of Nevada’s cell phone use while driving ban will fine drivers $50, $100 and $250 for first, second and third violations of the new law.

Benson and Bingham is one of Nevada’s leading personal injury law firms. While we practice all types of personal injury law, our firm has significant experience with Clark County Motorcycle accidents, pedestrian accidents and defective product cases. Our attorneys work very closely with our clients, developing strong relationships with them to best represent them in their personal injury case. We also offer our clients our exclusive happiness guarantee. If you are unhappy with your bill and representation at the end of your case, we will work with you to develop a fee structure you approve of.

3-Year Old Injured in Las Vegas DUI Crash

August 26th, 2012 No comments

Las Vegas car accidents continue to wreak havoc across Southern Nevada. Just after noon on Saturday, three Las Vegas residents were injured sitting at a bus stop on Owens Ave near Eastern Ave. The three people were hit by 22-year old Julio Enriquez driving a compact SUV. The three people who were injured were 37-year old Norma Orantes-Campos, her three year old daughter and 21-year old Carlos Jiminez. Mr. Jiminez suffered a broken arm, Ms. Orantes-Campo’s leg was broken and the three year old had serious injuries including a broken pelvis and two broken legs. All were rushed to University Medical Center for treatment.

After the downtown Vegas injury crash, Mr. Enriquez attempted to flee the scene. He was detained by witnesses in a parking lot approximately one mile away from the scene of the crime. Mr. Enriquez was charged by Las Vegas Metro Police for a number of offenses associated with the accident, including DUI in Las Vegas, not having a valid driver’s license and hit and run. Due to not having a driver’s license, it is highly likely that Mr. Enriquez does not have sufficient auto insurance to indemnify himself from the financial exposure from this crash. It is important for those hurt in Southern Nevada injury accidents to retain personal injury council so they are able to recover financially from the horrific event.

Benson and Bingham is one of Nevada’s leading personal injury law firms that represents those injured in Southern Nevada accidents. We specialize in automobile accident, head and back, defective product and casino negligence injuries. We stand by our success, having secured over $24,000,000 for our clients in 2010 and 2011.

Did Las Vegas Casino Negligence Contribute to the Death of Emily McCaughan

August 24th, 2012 No comments

Last June, the Electric Daisy Carnival was held in Las Vegas. The three day event held at the Las Vegas Motor Speedway had an attendance of 300,000 people, many tourists from outside of the Southern Nevada Area. Even though the show closed early on Saturday night due to high winds, the electronic music festival was relatively safe due to fewer arrests (12 felony drug possession arrests). No one during at the three day event was arrested for misdemeanor drug possession or alcohol intoxication. There were only two deaths associated with the festival.

One person who died due to the Electric Daisy Carnival was 31-year old Florida resident, Olivier Hennessy. Mr. Hennessy died after being struck by a pick-up truck while he was jaywalking leaving the event. If you or a family member has been the victim of a Las Vegas pedestrian accident, Benson and Bingham can help you recover financially from the accident.

Las Vegas Metro Police have finished their investigation regarding the death of 22-year old Arizona native Emily McCaughan. The police have concluded that Ms. McCaughan death was an accident and that she did not commit suicide. Ms. McCaughan was in her Circus Circus Hotel room when drug induced paranoia convinced her she was in imminent danger and she climbed out the window of her hotel room on the 27th floor. Spokespeople for the Circus Circus Hotel maintain that the window Ms. McCaughan climbed out of had a security latch that only hotel personnel could unlock and thus the window only opened six inches. It is unknown whether or not the Ms. McCaughan’s surviving family members have considered filing a Las Vegas casino negligence lawsuit.

Contact Benson and Bingham if you are involved in a Las Vegas Area Motorcycle Accident

August 23rd, 2012 No comments

Motorcycles are a mixed bag. They consume small quantities of gasoline and are very easy to maneuver through crowded and gridlocked city streets. Unfortunately, motorcycles are also very dangerous. While many riders use a complement of safety gear – helmets, gloves, leather jackets and pants with Kevlar inserts at the knees, elbows and shoulders and boots. However, when a motorcycle is speeding and hits something or is hit by a fast moving automobile, a motorcycle’s lack of protection can result in serious injuries and even death. If you or a relative has been injured or killed in a Las Vegas motorcycle accident the personal injury attorneys at Benson and Bingham can help you or your family recover financially and receive payment for lost work, medical bills, pain and suffering and more.

A recent example of a motorcycle accident due to high speeds that resulted in a death was in early August, a man, 20 years old, allegedly was speeding on a motorcycle and was hit by a 19-year old woman driving a Buick Regal. The aftermath of the accident also caused the injury of a man, 27 years old, who was stuck by the out of control motorcycle after the crash. The motorcyclist, named Mitchell Plamp, was pronounced dead by paramedics at the scene. The injured pedestrian, whose name has not been released, was rushed to Sunrise Hospital. If you or a family member was involved in this or a similar tragic accident, Benson and Bingham can represent you in a Henderson motorcycle accident personal injury law suit or a Henderson pedestrian injury case.

The personal injury law firm, Benson and Bingham has significant experience representing those injured in Southern Nevada motorcycle accidents. We have been in business since 2003 and have learned all the tricks played by insurance companies when they try to shirk their commitments.

Syphilis Outbreak Concerns Las Vegas Adult Industry Workers

August 22nd, 2012 No comments

Las Vegas is a large city that is home to many industries, casino gaming and entertainment the most prominent. Other industries that make their home in the 31st largest city in the United States include mining & natural resources, construction, manufacturing, transportation. Las Vegas has also seen a growth in high tech business including Zappos.com, videogame publisher Electronic Arts, IBM, videogame developer Petroglyph and more. One industry that has seen significant growth in Las Vegas is pornography. Sin City’s large number of inexpensive hotel rooms and fewer legal restrictions than California have increased adult-video production to multiple scenes and full scale production in Southern Nevada each month. The rise in production also, unfortunately, can spread sexually transmitted diseases. These diseases can bring about significant Las Vegas workers compensation exposure issues for video production companies based in Las Vegas.

It has recently been reported that significant adult-video production in Las Vegas and Los Angeles has been shut down due to a syphilis scare that has potentially infected many male and female adult performers. Last week, five performers tested positive for the disease, and each have begun taking antibiotics to battle the STD. An untreated syphilis infection can damage the brain, heart, liver, eyes bones and even blood vessels. Those who have reached the late stage of syphilis infection have trouble walking, speaking, seeing and even grow demented. If you have been injured in a Las Vegas workplace accident, Benson and Bingham can represent you in your Southern Nevada workers compensation case.

The family owned Las Vegas personal injury law firm of Benson and Bingham has been working with Nevadans since 2003 to help them financially recover from Las Vegas pedestrian accidents, spine, brain and back injuries and even injuries from defective products sold in Nevada. We develop strong relationships with our clients as we work to help them recover money for lost work, medical bills and even pain and suffering.

2012 Las Vegas Pedestrian Deaths Already Surpass 2011′s Total

August 21st, 2012 No comments

Unlike many of North America’s other great cities, Las Vegas was founded in 1905, not in the 1700s to 1800s. For most of the first half of the 20th Century, Las Vegas was a small town in the middle of the desert, a simple railroad stopover. However, with the building of the Hoover Dam, influx of scientists and the military for the Manhattan project and finally the legalization of casino gambling, Las Vegas began the rapid growth that created the city we love today. Las Vegas grew up in the days of the automobile and was not particularly designed to accommodate bicycles and pedestrians. This lack of city planning with pedestrians in mind is one of the main reasons Las Vegas and Southern Nevada have such a high amount of automobile accidents with pedestrians. If you have been involved in a Las Vegas pedestrian accident, contact Benson and Bingham today for a free legal consultation.

As stated above, Las Vegas was just not designed for pedestrian use. Take for example the recent pedestrian automobile accident involving 63-year-old Charles Leo Grazier. Mr. Grazier wanted to cross Boulder Highway, however, the nearest crosswalk was over a block away. Instead of walking the extra block out of his way, Charles Grazier decided to walk across Boulder Highway’s six lanes of traffic. As he was jaywalking, Mr. Graziewr was first hit by a van then run over by a pickup truck. Mr. Grazier was pronounced dead at the scene. Southern Nevada pedestrian accidents are a plague – if you have lost a loved one to a Southern Nevada pedestrian car accident, contact Benson and Bingham today to recover money spent on medical bills, lost work and pain and suffering.

Charles Leo Grazier’s death is a too common occurrence in Southern Nevada. The Las Vegas area is replete with high-speed multi-lane roads with few designated places for pedestrians to safely cross streets. As of July 2012, 29 pedestrians have been killed on Las Vegas roads. That’s nearly an average of one death every week. More pedestrians have been killed this year than all of 2011.

Benson and Bingham is one of Las Vegas’s leading personal injury law firms. We represent people in Clark County pedestrian accidents, defective product injuries, brain damage and casino slip and falls. We work to develop strong relationships with our clients to enable our success.

North Las Vegas Woman Injured After Bull Escapes

August 20th, 2012 No comments

Las Vegas animal attacks can result in significant hospital stays and bills resulting from bites, scratches, falls and even concussions. The most common Southern Nevada animal attack are obviously dog bits and dog attacks of humans and other canines. Other animals, domesticated, exotic and agricultural can also attack humans or pets and can cause significant physical and emotional damage to attack victims. Finally, animal attacks can also result in additional legal exposure for their owners, leading to Las Vegas wrongful death, brain and spinal injury and other lawsuits.

This weekend, a bull owned by Tom Collins, County Commissioner for Clark County escaped his pen had to be tranquilized by North Las Vegas police. A 42-year old woman was injured during the livestock’s escape, and she received medical attention, including stiches on her chin. The woman was on Mr. Collins’ property tending to a horse she boards with him. The woman received medical attention and due to the head injury was presumably checked for concussion and other brain injury symptoms. The woman had been assisting ranch hands at the Collins property using a cattle stick to direct the bull back towards his enclosure. The bull turned and pushed the woman up against a building, injuring her chin. If you have suffered injury due to an animal attack in Las Vegas, Benson and Bingham can assist you in recovering money you’ve spent or lost recovering from a Clark County animal attack.

The family owned and run personal injury law firm, Benson and Bingham was founded in 2003 by Ben Bingham, Esq. and Joseph Benson II, Esq. to serve the people of Southern Nevada in personal injury cases. Army Suicide Rate Continues To Increase Across Nevada and The United States

August 16th, 2012 No comments

Even though the Pentagon and Veteran’s Administration have significantly improved on post-traumatic stress disorder treatment and psychological treatment in general, twice as many active-duty soldiers committed suicide last month. In fact, throughout 2012, with fewer military personnel being deployed in Iraq and Afghanistan, suicides have continued to rise each month. In June 12 active-duty soldiers committed suicide, 16 in May and in July 26 took their own lives. The suicides have not been limited to active-duty soldiers – 12 Army Reservists committed suicide in June and July. Many of these soldiers have also suffered brain damage and other injuries from their active-duty service in the military. If you or someone you love has suffered from significant brain injury due to military service and you live in Nevada, Benson and Bingham can represent you in your Las Vegas personal injury case.

Only one of the potential suicides has actually been confirmed, however, the deaths continue to be investigated. The Army has also started to reach out to the individuals who have been impacted by suicide – their studies have shown that at a minimum ten others are affected negatively in the aftermath of a suicide.  Many suicides are often the result of significant psychological trauma from combat and can even arise from combat injuries to the brain. If you are the relative of a Las Vegas veteran who suffered from debilitating brain and spinal cord injury, contact Benson and Bingham to discuss your Nevada wrongful death inquiry.

Benson and Bingham were founded by cousins Joseph Benson, II Esq and Ben Bingham, Esq in 2003 to represent Nevadan’s in their personal injury claims and to help them financially recover from injuries. We represent soldiers from Hawthorne Army base in brain and spinal cord injury cases, casino slip and fall cases for companies based in Nevada and even Las Vegas defective product cases. We also represent tourists to Nevada from all over the world in vacation injury and wrongful death cases. We also offer a discount to military members.

Two Las Vegas Traffic Accidents Over The Past Weekend

August 13th, 2012 No comments

This weekend in Las Vegas, there were a couple significant car accidents in the Las Vegas area, one resulting in the death of a young man in a Las Vegas semitrailer accident and the other resulting in a Las Vegas pedestrian accident occurring to a 50-year old man who was working in his front lawn.

On Saturday, 21-year old Logan Browning suffered significant injuries when the Ford Mustang he was driving crashed into a parked semitrailer along Gowan Road near Rainbow Blvd. in the early morning hours. If you or someone you know has been struck by big rig truck in Las Vegas, contact Benson and Bingham today.

The 50-year old man, who was doing yard work on Sunday morning was struck down when a 17-year old, who did not have a license, plowed into him. The accident happened at 6125 Leaning Rock Ct at around 9:45am. The 17-year old, whose name has also not been released, will likely be charged with reckless driving and operating a motor vehicle without a license. If you have been a victim of a Las Vegas pedestrian accident, Benson and Bingham can help you to recover money spent on medical bills, lost work and pain and suffering, Benson and Bingham can represent you in a personal injury lawsuit.
