Nevada DOT Compiles Las Vegas and Nevada Accident Data and Reports Findings

March 31st, 2012 No comments

The Nevada Department of Transportation and the University of Nevada School of Medicine have created a database that tracks the medical costs from individual auto accidents in conjunction with the states four trauma hospitals. The four hospitals are Southern Nevada’s University Medical Center, Dominican Hospital, Sunrise Medical Center and Reno Medical Center. The data is being compiled to aid state and municipal lawmakers in traffic management. It has also brought to light the added costs associated with drunken driving accidents, driving without a seatbelt or operating a motorcycle with and without a helmet. If you have been injured in a Las Vegas traffic accident, while your data will be compiled, and while it may one day be used to increase the safety of Las Vegas and Nevada’s roads, you should still seek representation to ensure you are reimbursed for pain and suffering, lost work and medical bills.

Some of the data presented by the study’s newsletter, TREND, aligns with commonly held beliefs, others are very illuminating. Helmet use by motorcyclists is consistent whether or not alcohol was involved. The total cost across Nevada for pedestrians without health insurance injured in traffic accidents was over $64,000,000 from 2005 to 2010. While alcohol or drug use increases the likelihood of a traffic accident, it also increases the medical costs associated with the accident by nearly $20,000. If you have been involved in a Las Vegas traffic accident, contact Benson and Bingham for a free legal consultation today.

Benson and Bingham was founded in 2003 by cousins Joseph Benson II and Ben Bingham  to provide representation for car accident, wrongful death, personal injury and spinal cord/brain damage cases. Elevator Accident In Las Vegas’ Luxor Hotel Leaves Man in Critical Condition

March 28th, 2012 1 comment

What is the safest form of mass transportation ever developed? We’ve all heard of major and minor accidents from automobiles, planes, boats, motorcycles and trains. People can fall off bicycles. In fact, because millions of people, possible billions travel in elevators every day that is it. Sure, there have been horrific elevator accidents – just last fall in New York City, a woman fell to her death when an elevator door opened to an empty shaft. So accustomed to the safety of elevators, 41-year old advertising executive Susan Hart had no idea she was walking to her death as she entered an elevator on December 14th. Ms. Hart was crushed when the elevator abruptly jerked upwards, crushing the woman between the building’s 1st and 2nd floor. Maintenance workers had disabled the elevator’s safety functions. If you or a family member has been injured or killed in a Las Vegas elevator accident, contact Benson and Bingham for a free legal consultation today.

A recent accident in Nevada highlights the latent dangers of high rise buildings’ reliance on elevator technology. Late Friday night, in Las Vegas’ Luxor Hotel, a man who had been fighting with friends was thrown towards the doors of an elevator shaft in the mega hotel’s West Tower area. As the man crashed into the elevator doors, they mistakenly opened and he fell 25 feet to the hotel’s basement. While he wasn’t killed, the man, whose identity has not been released, was rushed in critical condition to University Medical Center. If you or someone you love was injured or killed by a Clark County elevator, you may be owed reimbursement for lost work, pain and suffering and medical expenses. The attorneys at the law offices of Benson and Bingham have significant experience on wrongful death and injury cases.

Accidents in Las Vegas happen every day. People are injured or killed sometimes by mistake, others through true accidents. Regardless of the cause, if you were injured or had a loved one injured or killed in a Las Vegas elevator accident or something similar, contact Benson and Bingham today. It is very likely our attorneys have represented countless Nevadans in cases similar to your own.

Las Vegas School Bus Accident Reverberates Through Southern Nevada Communities

March 25th, 2012 No comments

A recent Las Vegas school bus accident resulting in the death of an 11-year old Kaylee Derks continues to reverberate across the communities of the South Valleys. This tragedy has called into question school bus routes in the community, protocols for reversing a bus’ direction and even a new system wide computer program that tracks bus routes and driver progress. News of the accident has even affected Las Vegans who never met young Kaylee: Barbara Bundy, has had significant trouble sleeping since hearing of the accident, as she was the mother of Brandi Bundy, a 5-year old who died twenty years ago after a very similar Las Vegas school bus accident. If you have been injured or had a family member killed due to a Las Vegas pedestrian accident, contact Benson and Bingham today.

Leslie Rice, the 46-year old bus driver involved in the accident has not returned to work. He was tested and passed an alcohol and drug tests at the scene and was described as witnesses as inconsolable. School bus union officials have taken issue with the bus route that ran through Kaylee’s neighborhood as a contributing factor to the accident – the driver must make a three point turn in an area where there are many parked cars along the street. Las Vegas pedestrian accidents happen almost every day – if you have been injured or had a family member killed, hiring an attorney is the first step you must take to recover reimbursement for pain and suffering, medical costs and lost work.

Benson and Bingham is the leading Las Vegas personal injury law firm that specializes in making sure those hurt are made whole. In 2010 and 2011, we secured over $24,000,000 in reimbursement for our clients. If you have or a family member has been involved in a Las Vegas pedestrian accident, contact Benson and Bingham for a free legal consultation today.

Las Vegas Motorcycle Deaths Concern Authorities

March 24th, 2012 No comments

2012 has already been deemed an especially deadly year for Las Vegas pedestrians but a close look at traffic fatality statistics shows another type of accident fatality on the rise. So far this year, in Las Vegas, there have been five horrific motorcycle fatalities. In each of these cases, those on the motorcycles were under 30 years old and were likely speeding at the time of the fatal accidents. In addition, each of the victims were on so called “crotch rockets,” high powered racing motorcycles capable of reaching speeds in excess of 200 miles per hour. If you or someone you love has been involved in a Las Vegas motorcycle accident, and wish to recover lost wages, medical costs and reimbursement for pain and suffering, contact Benson and Bingham for a free legal consultation today.

In each of these deaths, police say speed was a factor. For example, on February 4th, a 26-year old on a motorbike struck a curb and was killed the instant he hit the sidewalk. Another young man of 23-years old was killed the next day when his bike hit a passing automobile. This was followed by a 28-year old man being killed when his motorcycle met an SUV in an intersection. About a week later, a 22-year old speeding on a crotch rocket hit a pick-up truck trying to turn right. In each of these tragedies, the tragedy included a young man speeding on a high powered motorcycle. If you have suffered an injury due to a collision with a high-speed motorcycle in Las Vegas, contact Las Vegas personal injury attorneys Benson and Bingham today.

Benson and Bingham was founded by two cousins in the hope of securing the best possible financial settlements for those injured in Las Vegas accidents. The firm has two main advantages over its competitors; our firm has a significant technological advantage over our southern Nevada competitors and our attorneys pride themselves on developing strong, trusting, long-lasting relationships with those we represent.

Are you a Nevadan Whose Beloved Pet Been Sickend By Poisoned Chinese Dog Treats?

March 22nd, 2012 No comments

Nearly 600 dogs across the United States and Nevada have mysteriously fallen ill. One commonality the dogs all share is recently eating dog chicken flavored dog treats manufactured in China. Many different brands of the treats have ties to the ailing pets: Waggin’ Train Jerky Treats, Canyon Creek Jerky Tenders and Milo’s Kitchen Home-Style. The manufacturers of the treats, Del Monte and Nestle Purina, have stated they believe the dog food to be safe and that the food is rigorously tested. If your dog has recently fallen ill, and you suspect defective dog treats, contact Benson and Bingham for a free legal consultation today. We can help you get reimbursed for veterinary bills, pain and suffering and even lost work.

The Food and Drug Agency is investigating how exactly what about the treats may be ailing the dogs. Since 2007, the FDA has issued three cautions regarding pet products manufactured in China. The ailments the FDA suspects have been caused by the potentially poisoned dog jerky include liver disease, kidney failure and even Franconi syndrome. Dogs started falling ill in October and reports continued through December. The FDA is currently holding off on a recall due to the facts that no specific products have been definitively tied to the pet illnesses. A poisoned dog can cause a significant financial hardship on his or her owners. If your Las Vegas pet has suffered sickness from food poisoned food it may have eaten, you may be able to sue for reimbursement.

The attorneys at Benson and Bingham know how devastating it can be when any member of the family is sick – and we know that our pets are an integral part of many families. Our practice has been successful because we focus on building strong lasting relationships of trust with our clients. In fact, our two founding partners are family, cousins Joseph L. Benson II, Esq. and Ben J. Bingham, Esq.

Weekend of Heavy Rains Spur Las Vegas Traffic Accidents

March 20th, 2012 No comments

The heavy rain experienced by Southern Nevada last weekend was welcomed by municipal water officials, home owners and gardeners across Clark County. However, the heavy downpour experienced by our city also spurred a higher than usual amount of car accidents in Las Vegas and the surrounding area. Heavy rains can spur accidents because when roads are wet, drivers’ visibility declines, traction on roads deteriorates and puddles create road hazards. Las Vegas drivers are doubly susceptible due to their relative lack of experience with inclement weather. Nevada traffic law anticipates the added danger of driving in the rain, as drivers are required by Nevada law (NRS 484B.603) to drive below the speed limit in inclement weather. If you were a victim of a Las Vegas traffic accident in this weekend’s rainstorms, contact Benson and Bingham for a free legal consultation.

One of the worst this weekend was a three car accident in North Las Vegas that resulted in eight people being sent to the hospital. Taking a left turn at a traffic light, a truck didn’t see two vehicles coming from the other direction. The truck struck one vehicle and the 2nd vehicle slammed into a third. One of the vehicles was so badly damaged that one of the drivers had to be freed by the Jaws of Life. Police cite speeding in the rain as one of the major factors in the crash. If you were a victim in this or any other North Las Vegas vehicle accident, and wish to be reimbursed for lost work, medical bills, pain and suffering, contact Benson and Bingham today.

Our firm, Benson and Bingham is one of Las Vegas leading personal injury law firms. In 2010 and 2011 we secured for our clients over $24,000,000 in awards through negotiation and by going to trial. Our industry leading client service focus and advanced technology integration helps us to provide the best possible representation for those we represent.

The hip implant was recalled in August 2010 due to failure rate deemed too high.

The replacement hip was released by Johnson and Johnson subsidiary DePuy in 2005, without significant clinical trials to confirm its safety. In 2008, the US Food and Drug Administration began to get complaints about the device – surpassing 400 in a short period of time. In 2010, A statistical analysis of the returned hips showed an astoundingly high failure rate of 13%. Reasons for the failure of the devices include component misalignment, component loosening, infections, bone fraction and pain. Those who have the hip replacement have shown symptoms of nerve damage, muscle damage, tissue damage, swelling, necrosis, and high levels of iron in the blood. If you are a Nevadan with a DePuy ASR Hip replacement, and have suffered complications from the defective medical device, contact Benson and Bingham for a free consultation today.

Lawsuits regarding the ASR hip replacement state that the company knew about the hip replacement’s defective design and that they did nothing to warn patients and doctors of those issues. Due to the large number of pending lawsuits, the US Judicial Panel on Multi District Litigation consolidated the cases and transferred them to a North Ohio court. Las Vegas residents, who have suffered from the recalled DePuy ASR Hip Replacement, should contact Benson and Bingham immediately. Pfizer Birth Control Recall May Create More Native Nevadans

March 15th, 2012 No comments

In Late January, multi-national pharmaceutical giant Pfizer announced, in coordination with the US Food and Drug Administration, the recall of approximately 1 million birth control pills. The miss packaged pills provide no health risks; however, they do increase the risk of pregnancy for those taking the medication. The pills, a 28 day regimen including 21 doses of the medication and seven placebos were mislabeled. Customers who have the affected packages are warned to begin using a secondary form of birth control, contact their physician and return unused portions to their pharmacy for replacement. The extent of Pfizer’s legal exposure from the product recall is unknown – as the laws in many states could hold them liable for all the associated costs of the unwanted pregnancies. If you have taken the recalled Pfizer birth control and are pregnant with a new native Nevadan or were sickened by defective prescription or over the counter medication, contact Benson and Bingham for a free legal consultation today.

There are many levels to Pfizer’s potential legal exposure. Should they have to pay for any unwanted pregnancies? Should it be for the medical costs and lost work up to the birth of the child? Should it include food, presents, clothing and education for the child of one of these unwanted pregnancies? What if the unwanted pregnancy resulted in a child with special needs? What if the woman was taking the birth control because she had evidence she and her partner would have a child with special needs.

If you are a Nevadan who has fallen victim to incorrectly prescribed or defective medication and wish to recover damages for healthcare costs, pain and suffering and lost work, Benson and Bingham have the legal experience to represent you fully. In 2010 and 2011, our attorneys were able to secure over $24,000,000 in damage awards for our clients. Please contact Benson and Bingham today for a free legal consultation.

Afghanistan Mass Murder Highlights Need For Better Mental Health Treatment For Nevada and US Veterans

March 13th, 2012 No comments

The news from Afghanistan this week has saddened and shocked all Americans. A US soldier went on a rampage, shooting and killing 16 people, including nine children and 3 women in Kandahar Province. An unnamed 38-year old staff sergeant, who is a father of two and a veteran of three tours of duty in Iraq, went from home to home shooting the Afghani civilians as they slept. When finished, the shooter returned to his base and confessed.

This terrible tragedy is the latest in a series of horrifically violent events that have happened at the hands of soldiers from the much-maligned Lewis-McChord US Army base just south of Tacoma, Washington. Other violent incidents committed by soldiers from this base include an ex-soldier who murdered a park ranger, a staff sergeant who tortured and raped two women and a 19-year old private who murdered a teenage girl.

It is unknown what has spurred the violent incidents emanating from this base, but as we wrote about last month, Madigan Healthcare System, the army hospital at Lewis-McChord, was cited for cautioning doctors to avoid diagnosing soldiers with brain damage and post-traumatic stress disorder due to cost concerns. If you are a Nevada veteran suffering from brain damage or post-traumatic stress disorder and were misdiagnosed by the military of Veterans’ Administration, you deserve to be reimbursed for your medical costs, lost work and other pain and suffering. Contact Benson and Bingham today for a free legal consultation.

The attorneys at Benson and Bingham salute and honor all of Nevada’s and our Nation’s veterans. We believe those who have sacrificed and dedicated their lives to our country deserve exemplary medical treatment from the VA. We even offer veterans an exclusive military discount. Some of our practice’s key competencies are brain injury and PTSD. Please contact us today to ensure you get the representation you deserve.

Las Vegas Continues to Debate Additional Penalties for Aggressive Dog Attacks

March 11th, 2012 No comments

As Las Vegas, Nevada debates changes in punishment for the owners of dogs that attack others, more and more people have been injured and nearly killed. The breed that seems to always come under scrutiny, pit bulls, are yet another breed that has raised the ire of the American people. Over the decades, many dog breeds have been accused of over aggression – Rottweilers, German Shepherds, etc. Many dog lovers do not believe various breeds are the problem behind the attacks. Instead, these advocates for canines state that any dog, when mistreated and rewarded for acts of aggression can become violent and attack innocent people and canines. If you have suffered a Las Vegas dog attack, and wish to sue for lost work, pain and suffering and for the medical bills you have incurred, contact Benson and Bingham for a free legal consultation today.

The consequences from dog attacks can last a lifetime. While cuts and bruises heal, scars from bites linger for decades and those attacked can live with paralyzing fears of mans’ best friend. Just this December, 9-year old Alexis Gates was attacked in her Las Vegas neighborhood. The dog came running at the young girl and bit her savagely on her lip and leg. Even though she was rushed to University Hospital after the attack, Miss Gates still has to work at extensive physical therapy. Emergency Room visits, treatments, psychological counseling and physical therapy can be very expensive. If you have been injured in a Clark County dog attack and wish to be reimbursed for medical bills, pain and suffering and lost work, contact the personal injury attorneys at Benson and Bingham.

Established and 2003, Benson and Bingham quickly became one of the leading Las Vegas personal injury law firms. Our attorneys work with each of our clients to develop a strong trusting relationship. These relationships have been the key to our firm’s success, evident by the over $24,000,000 in claims we were able to secure for our clients in 2010 and 2011.
