Echo Gas Powered Blowers Recalled

February 28th, 2012 No comments

Citing a potential fire hazard, the Consumer Product Safety Commission today announced a recall of gas powered blowers in conjunction with their manufacturer, ECHO, Inc. from Lake Zurich, Illinois. The recall cited a potential fuel line issue which could lead to fuel leaking from the machine during use. This fire hazard poses a significant risk In continually dry Nevada, an area already prone to wildfires. For safety reasons, the CPSP cautions to discontinue use of the equipment and contact ECHO for instructions on how to return the unit to an authorized service dealer. If you have been injured by an ECHO Powered Backpack blower, and wish to recover medical costs, lost wages and remuneration for pain and suffering, contact Benson and Bingham for a free legal consultation today.

Las Vegas and the rest of the state of Nevada are extremely dry desert climates, requiring homeowners to be extremely diligent in clearing away excess brush, tumbleweeds and dead plant matter. Reno in Northern Nevada, due to an extremely dry winter, has seen two significant wild fire events in the past 4 months. Should the ECHO Power Blower malfunction in many areas across Las Vegas and Southern Nevada, the potential for significant injury and damaged property is extreme. If you have experienced an ECHO Power Blower injury in Las Vegas, contact Benson and Bingham today to discuss your case.

Benson and Bingham are one of the most successful and technologically advanced personal injury law firms in Southern Nevada. However, the main reason for our success has not been because of our ability to use technology, but instead on our ability to develop trusting relationships with the clients we represent. We take pride in helping people during some of the worst periods of their lives. While we cannot promise a positive outcome to your case, the $24,000,000 we secured for clients in 2010 and 2011 illustrates how successful our approach has been.

New Study Investigates Brain Damage in Las Vegas Boxers

February 26th, 2012 No comments

Nevada has always been a leader nationally in boxing and other pugilistic sports. The casinos of Las Vegas have always used the fight game, in whatever form, to draw people to its hotels and gaming floors. These sports, however, can have a drastically detrimental effect on some of its participants – specifically brain damage in the form of pugilistic dementia. With Boxing, Mixed Martial Arts and Muay Thai all promoted and licensed enthusiastically across the State of Nevada, many from the silver state have suffered debilitating brain injuries from the sport. If you have suffered brain injury in a Nevada licensed fighting sport, contact Benson and Bingham today for a free legal consultation to discuss your case.

Recently, the Cleveland Clinic opened the Lou Ruvo Center for Brain Health in Las Vegas. To mark the opening Las Vegas hotel owner Kirk Kerkorian has funded a study to perform baseline magnetic resonance imaging scans on 600 fighters in the course of a four year brain study. One of the main goals of the study is to determine why some fighters get brain injury while others do not. The types of brain damage incurred by fighters can include Parkinson’s disease, Pugilistic Dementia, and Early Onset Alzheimer’s. In addition to the baseline MRIs, fighters in the program will also memory and cognitive reasoning tests, with quizzes on judgment and reasoning. If you are suffering traumatic brain injury in Las Vegas from a past as a boxer or MMA fighter, and wish to recover money for hospital bills, lost work and pain and suffering, contact the attorneys at Benson and Bingham to discuss your case.

Benson and Bingham are Las Vegas injury attorneys who specialize in all types of injury cases. They and their staff are able to successfully represent their clients by developing strong trusting relationships. Nevada Second in Nation for Traffic Fatalities Involving Elderly Drivers

February 25th, 2012 No comments

Last October, Mia Decker and her friends Alyssa and Rain Mowrey began walking across Camino Eldorado in North Las Vegas.  Moments later, Alice Alava approached in car, moving to the right lane to avoid another car stopped at the cross walk. As she proceeded through the intersection, Ms. Alava struck and killed Mia Decker and injured the Mowrey sisters. Alyssa Mowrey is still struggling to recover from significant brain injury from the accident.

Ms. Alava was sentenced Thursday in N. Las Vegas Municipal Court on Thursday for the fatal accident. The 78-year old will lose her license for two years and must pay $5000 in fines. She was cited in five counts, including failure to yield for a pedestrian in an intersection, not paying full attention to driving and failure to yield for a car in a crosswalk. If you or a relative has been injured or killed by in an accident with an elderly Nevada driver, contact Benson and Bingham for a free legal consultation today.

A recent nationwide study by the American Association of State Highway and Transportation Officials compiled accident and traffic fatality statistics. Their findings showed that Nevada drivers 65-years and older were involved with 24% of Nevada traffic deaths in 2010. Many factors contribute to the declining safety of the elderly driver.  Reduced peripheral and night vision can be a leading factor in an accident. An elderly driver’s declining ability to concentrate and handle stressful situations can contribute to fender benders or worse. The pain of arthritis can make the rapid movements necessary to avoid a car crash tremendously painful. Finally, over the counter and prescription medications can induce drowsiness, slow reaction times and add to the general danger of a elderly individual behind the wheel. If you believe a Las Vegas fatal or injury traffic accident were the cause of a drivers age, and wish to recover money for medical bills, lost work and pain and suffering, contact Benson and Bingham for a free legal consultation today.

In 2010 and 2011, Benson and Bingham won over $24,000,000 in injury awards for their clients. The attorneys’ success is due to the strong relationships the firm’s attorneys build with their clients. Its these trusting relationships that enable our attorneys to negotiate successfully on our clients’ behalf.

Are You a Nevada Veteran Denied a PTSD Diagnosis and Treatment?

February 23rd, 2012 No comments

America’s all-volunteer military sacrifice tremendously to serve their country – whether they are stationed domestically or overseas in a war zone. These brave young men and women face low wages, time apart from friends and family, debilitating injury and even the ultimate sacrifice, death. For much of the 20th Century, American soldiers received significant respect and benefits from the service – the GI Bill and the Veterans’ Administration helped educate and keep healthy generations of veterans. The attorneys of Benson and Bingham salute our veterans from Nevada and across the country.

The announcement today that soldiers suffering from post-traumatic stress disorder were repeatedly called “malingerers” by the cost conscious doctors and administrators of the Madigan Army Medical Center in Tacoma, WA were extremely disheartening to all Americans. The Department of Defense has received a significant amount of complaints from soldiers stationed at Lewis-McChord, an army base serviced by Madigan. The base, which had sent the largest number of troops in the country to fight in Afghanistan and Iraq, has been plagued by rising rates of alcoholism, family and spousal abuse, and soldiers complaining of significant memory lapses, uncontrollable rages and vivid nightmares. If you are a Nevada veteran suffering symptoms of Post-Traumatic Stress Disorder and feel you were misdiagnosed by the Veterans Administration, contact Benson and Bingham for a free legal consultation today.

Testimony has lead to a presentation given by a forensic psychiatrist from Madigan which detailed the costs to the taxpayer associated with a diagnosis of PTSD. While evidence of pervasive non-diagnosis of the stress disorder is still pending, the entire affair is currently being investigated by the US Senate’s Veteran Affairs Committee. Two physicians and a Colonel, a West Point Graduate, have been suspended due to the pending investigation. If you are a Nevada Veteran with PTSD and have been misdiagnosed by the US Army or Veterans Administration, you deserve legal protection. Contact Benson and Bingham today for a free legal consultation.

Joseph Benson II, Esq.  and Ben Bingham, Esq. are partners in the Nevada’s leading personal injury law firm. We represent clients of all ages and in all types of injury cases. TEVA Parenteral Reaches Settlement on Las Vegas Hepatitis C Case

February 21st, 2012 No comments

The long road of the Las Vegas TEVA Hepatitis C lawsuit is nearing its end. It was announced in Las Vegas today that a court-ordered mediation of the more than forty lawsuits surrounding the case have reached a settlement. While terms of the settlement were not disclosed, it is assumed that the original jury award of nearly $800 million was significantly reduced. TEVA spokesperson Denise Bradley stated that the Israeli firm had budgeted $285 million to settle the lawsuits. Just last month, the settlement talks were ordered by the Nevada Supreme Court. If you or a relative has been sickened or killed by an over dose or poor handling of a prescription, contact Benson and Bingham for a free legal consultation today.

Wrongful death lawsuits from the careless dispensation of prescription medications, however, continue. A Louisville woman was killed when her prescription for Hydralazine was erroneously filled with another drug called Hydroxyzine. Hydralazine is used to treat high blood pressure, Hydroxyzine is a prescription antihistamine. While Moore’s incorrect prescription was fixed two weeks later, the woman passed away after she was hospitalized with congestive heart failure, kidney failure and high blood pressure. If you or a loved one has been sickened or passed away due to a prescription that was erroneously filled, contact Benson and Bingham today.

The fallout from the TEVA Hepatitis C outbreak caused significant repercussions across the Las Vegas medical community. Nevada medical professionals are now required to attest they have taken continuing medical education courses on safe injection practices. Patients were sickened after they were administered the anesthetic Propofol by a Las Vegas Gastroenterologist Dr. Dipak Desai. Dr. Desai is currently pending trial and is free after posting a $1 million bail bond. If you were sickened by the incorrect filling of a prescription or from the misuse of drugs by a Las Vegas physician, contact Benson and Bingham for a free legal consultation.

One of the leading personal injury law firms in Las Vegas and Southern Nevada, Benson and Bingham work to develop strong relationships with their clients. These strong trusting relationships are the foundation of a strong personal injury case. While no attorney can promise a successful outcome to your personal injury lawsuit, our success speaks for itself. In 2010 and 2011, our clients received over $24,000,000 in awards to reimburse medical costs, lost work and pain and suffering.

Man In Diabetic Shock Severly Beaten By Henderson Police and NHP

February 12th, 2012 No comments

Late one morning in October 2010, Adam Green was behind the wheel of his car, weaving and out of control. Nevada State Troopers and Henderson Police finally pulled over Mr. Greene, but when they had to remove the driver from the car, things started getting violent. Mr. Greene was dragged out of his automobile at gunpoint and was held on the ground as four Henderson Police and NHP restrained him. Then a fifth uniformed policeman walked over and kicked the man several times in the head. Eventually, Mr. Greene was searched by the assaulting officers who found insulin. At this point they realized the man who had been thrown to the ground, handcuffed, beaten and repeatedly kicked in the head was suffering from a diabetic shock.

Video of the event where Mr. Greene was beaten was recently shown by his attorney during the lawsuit against the Henderson Police and the Nevada Highway Patrol. However, if you have suffered physical harm from an incident with Las Vegas Metro Police, NHP, Henderson Police or any other Southern Nevada Police department, please contact Benson and Bingham for a free legal consultation today.

While your incident may not have been as violent or as cut and dried as the one where Adam Greene was beaten, you still may be able to reimbursed for medical costs, lost work and pain and suffering. If a Las Vegas area traffic stop resulted in an injury, contact Benson and Bingham to discuss representation today.

Many factors should be taken into consideration as you make your decision to hire a Nevada personal injury law firm. You should try to find attorneys that you believe will vehemently represent you and communicate the details of your case. Benson and Bingham work to develop long term client-lawyer relationships based on trust, communication and mutual respect. Football Dominance Threatened By Head Injury in Nevada and Across the Nation

February 11th, 2012 No comments

Again, this year, a record amount of people watched the Super Bowl – Neilsen Co. estimated that this year 111.3 million people. The records have been surpassed each of the last three years. That’s what makes it so inconceivable that in 10 to 15 years the Super Bowl and NFL football as we know it could be gone.

The greatest threat to the NFL’s hegemony of the sports landscape is likely not the NBA, the NHL, Major League Baseball, Tennis or Major League Soccer. The threat comes from the long-term health impact of the repeated concussions that occur to players at every level of the game. While the culture of football from high-school to college to the NFL has changed with regards to player health and concussions, little is known medically regarding the long term effects of even a single concussion on a developing mind. If you or a relative has suffered from the lingering brain damage in Nevada due to post concussion symptoms that occurred while playing high school, college or pro football, contact Benson and Bingham for a free legal consultation today.

As more is learned about the long term effects of concussions, more and more parents could not elect to let their pre-teen or high school aged boys to play the game. As fewer and fewer boys play, it may lead to less talent graduating to professional football, thus reducing the talent pool entering the game . Other hindrances to young people playing football could be insurance related. As the cost of insuring high school players and programs rise, fewer will be offered reducing the talent pool to the league even farther. If you have suffered from post-concussion brain injury from playing football in Nevada on any level, contact Benson and Bingham for a free consultation today.

Benson and Bingham are one of Las Vegas’ leading personal injury law firms, specializing in making sure those injured by others get reimbursement for health care costs, lost work and pain and suffering. While no law firms can promise a successful outcome to your case, we work to develop trusting long-term relationships with our clients.

Las Vegas DUI Accidents Plague Southern Nevada Super Bowl Sunday

February 9th, 2012 No comments

Despite repeated warnings and admonitions from Las Vegas and South Valley’s police departments, Super Bowl weekend was  particularly deadly on Southern Nevada streets and highways. If you or a loved one has been critically injured or killed in a Las Vegas car accident, contact Benson and Bingham for a free legal consultation today.

One person was killed and another injured in a Las Vegas DUI accident on Sunday evening after the Super Bowl. The accident occurred near the intersection of W Wigwam Ave and S. Rainbow Blvd at 8:48 pm when a Toyota 4 Runner driven by Veronica Arana crossed into oncoming lanes and struck a 2004 Ford Mustang and a 2011 Honda Pilot. The driver of the Mustang was killed in the accident and pronounced dead. The 17-year old driver of the Honda Pilot suffered minor injuries and was not hospitalized. Ms. Arana was rushed to University Medical Center due to moderate injuries suffered in the crash and was later charged with a DUI and faces reckless driving charges as well. If you or a loved one has been injured in a similar Las Vegas DUI accident, contact Benson and Bingham today.

Earlier on Sunday, a Las Vegas elementary school teacher is alleged to have struck and critically injured a 15-year old teenager waiting at a bus stop. The teacher, 26-year old Noel Lardeo, was alleged to be speeding and running a red light. Las Vegas Metro Police are reporting the young woman swerved and lost control of the vehicle, eventually hitting the teen boy, whose leg was later amputated. Ms. Lardeo faces a litany of charges including driving an unregistered vehicle, driving without a license, failure to stop, DUI and having an open container in a moving vehicle. Benson and Bingham have  successfully represented many victims of  Las Vegas driving while intoxicated.

A leading Las Vegas personal injury law firm, Benson and Bingham secured over $24,000,000 in injury awards for its clients in 2010 and 2011. When choosing a Las Vegas injury attorney, try to find one that emphasizes communication between its attorneys and clients. Legal journals show that the most successful cases are those where the level of communication between client and attorney is high.

Las Vegas Metro Police Accident Kills Father

February 7th, 2012 No comments

It’s late and your husband isn’t home yet. It’s the 4th of July, and you know he had a drink with friends, but he did not sound impaired at all when you spoke to him on his cell phone. Your husband should be home. Then, a knock on the door. Confused at who could be stopping by this late at night, your heart stops as you recognize the Las Vegas Metro Police Department uniforms. You collapse to the floor as they tell you of their husband’s death behind the wheel. Your mind reels, how will you take care of your children? How will you survive? If you have lost a loved one to a case of wrongful death in Las Vegas, contact Benson and Bingham today for a free legal consultation.

In July 2007, the wife of Raymond Yeghiazarian went through much of what is written above. Mr, Yeghiazarian, was attempting to take a left turn at the intersection of Fort Apache Rd. and Sahara Ave. when his car was struck, head on, by a police cruiser driven by Las Vegas Metro Police officer, Jared Wicks. Wicks, traveling at an estimated 60 to 75 miles per hour, did not slow down as he approached the intersection. In addition, even though Officer Wicks was in hot pursuit of a suspect, neither the officer’s sirens or lights were on. If your loved one was killed in an accident with LVMP or other instance of Las Vegas wrongful death, contact Benson and Bingham today.

Ms. Yeghiazarian was initially awarded $2.2 million by a Las Vegas jury, however that was quickly reduced in accordance with Nevada Revised Statutes which hold municipalities to a maximum liability of $250,000. Recently, Ms. Yeghiazarian filed an additional federal civil rights suit, alleging Las Vegas authorities withheld significant information about the crash.

If you suspect your recent Nevada tragedy is actually a case of wrongful death, Benson and Bingham, Southern Nevada’s premiere personal injury attorneys are available to discuss your case. In 2010 and 2011, the law firm was able to secure over $24,000,000 for their clients. While we cannot promise a successful outcome in your case, our Nevada licensed attorneys will help you recover medical costs, pain and suffering and lost wages.
