NV For-Profit Nursing Homes Show Care Deficiencies

December 31st, 2011 No comments

UC San Francisco recently released a report comparing the quality-of-care in nursing homes across the country. The report compared the ten largest for profit nursing homes with the care in other for profits, non-profits and even government run homes. In general, the report’s findings showed a  better quality of care and higher staffing levels at non-profit and government run facilities. If you believe your loved one has received sub-par care in a Nevada nursing home, contact us today.

In the ten largest nursing homes, the report found that patients had more complaints and incidents of pressure sores, weight loss, falls, infections, mistreatment by staff, unsanitary conditions and more. These higher incident rates stem from lower staffing levels at large, chain operations where patient care is secondary to making a profit. Please contact Benson and Bingham at Bensonbingham.com or 702-382-9797 to discuss the neglect of any Nevadan in a Silver State nursing home.

NV Accident Liability Ranges Farther Than Expected

December 30th, 2011 No comments

In 2008, 18-year old Hiroyuki Joho, ran across train tracks in an effort to catch another train. Distracted by torrential rains and a large umbrella, Mr. Joho was struck and killed by an oncoming train. At impact, parts of Mr. Joho’s body were thrown, striking Ms. Gayane Zokhrabo approximately 100 yards away. Ms. Zokhrabo suffered a broken wrist, arm and injured shoulder. In Nevada, innocent bystanders can be injured in cases of negligence. Contact Benson and Bingham today for consolation, free of charge.

Injured not only physically but also financially, Ms. Zokhrabo sued the estate of Mr. Joho, looking to recoup medical costs, lost pay and other expenses. While initially struck down, the case was reinstated on appeal – simply put, a person running across train tracks has an expectation that should he or she be hit, their body or belongings may strike and injure another person. Honda Airbag Recall Affects Nevada Drivers

December 29th, 2011 No comments

Honda Motors recently announced a recall of an additional approximately 275,000 vehicles, adding to the over 600,000 previously announced for a faulty airbag issue with older model Accord, Civic, Odyssey, Pilot and Acura models. The parts being recalled were installed in 2001 – 2003 vehicles repaired by the Japanese Auto manufacturer. Contact us if you have been injured by a Honda airbag in Nevada.

When driving an automobile equipped with a driver’s-side airbag, it is important to wear a seatbelt and operate the vehicle a safe distance from the steering wheel. In an accident, an airbag can explode with a force that can break a nose, glasses or cause other serious injury. If you have been injured in a Clark County auto accident and would like representation contact Benson and Bingham today.

Declining NV Autopsy Rates Hide Malpractice Deaths

December 23rd, 2011 No comments

As autopsy rates across the nation continue to plunge, health care professionals are losing valuable learning opportunities as the families of those who passed away desperately search for answers. Doctors and hospitals across Nevada have shied away from the practice because it can highlight areas of malpractice. If you believe you or a relative have been injured while seeking medical care, contact us today.

Due to decreased insurance coverage, autopsies are now only routinely performed when foul play is suspected. This, however, reduces the opportunities for those who may have been fatally injured by medical malpractice in Nevada to discover the actual cause of death. If you suspect malpractice, contact us and we can help ensure all correct procedures are followed.

Benson and Bingham’s website, www.bensonbingham.com has significant information on family and patient rights. Please contact us today to begin the discussion of your case.

NV Mines Cited For Workplace Safety

December 22nd, 2011 No comments

A recent inspection by the Mine Safety and Health Administration cited Nevada mining operation Yukon-Nevada Gold Corporation’s Jerritt Canyon Mill in Elko for multiple safety violations. The inspection was part of a nationwide inspection tour, itself a result of last summer’s explosion at Massey Energy’s Upper Big Branch Mine in West Virginia. The Jerritt Canyon Mill was cited for not properly disposing and storing combustible waste, barricading unsafe areas or adequately protecting workers from moving machine parts. If not fixed, these violations put workers at significant risk of personal injury including amputation injuries, wrongful death and brain damage.

In addition, the MHSA announced the Barrick Goldstrike’s Meikle Mine in Carlin was responsible for the death of two employees in an August 2010 accident. The two men, Daniel Noel and Joel “Ethan” Schorr, of Spring Creek, were killed when a clogged pipe struck them in a ventilation shaft. If you or a relative have suffered a workplace injury, contact us today at bensonbingham.com.

NV Health Care Workers At Greater Risk of Injury Than Any Other Profession

December 18th, 2011 No comments

A recent study published by the US Department of Labor shows health care workers are among the most susceptible to workplace injury. Nevada health care injuries include needle pricks, back injuries and post-traumatic stress disorders. If you have been injured in Nevada working with patients or in any other profession, please contact us today.

Statistics published by the labor department showed workplace injury statistics for mining (2.3 per 100 workers), construction (4.0) and manufacturing (4.4) were much lower than the 5.2 per 100 injured doctors, nurses and health care technicians. Across the country and Nevada, health care workers can often contract diseases like hepatitis, HIV and other blood borne illnesses. Sometimes, these diseases can take months to years to develop. We have the experience with Nevada statutes to ensure you get your day in court for a Nevada workplace injury.

Five killed in Las Vegas helicopter tour crash

December 15th, 2011 No comments

A mid-week Las Vegas helicopter crash killed all four passenger and the pilot, and state and federal investigations of the incident continue. The tragedy was saddening not only for the lives lost and the families devastated by loss but also because of its eerie familiarity; Nevada air accidents of this type sadly are becoming somewhat commonplace. As investigations continue to determine the cause and possible fault behind this dark occurrence, one must ask if policy changes are needed to prevent further tragedies.

Initial reports indicate that the crash was an accident, with some kind of mechanical problem or extreme weather causing the helicopter to crash into the side of a mountain near Lake Mead, Nevada. Autopsies indicate that the victims all died from a combination of blunt-force trauma and burn injuries, and they likely had little or no chance of surviving the crash even with the most speedy emergency response. Inspectors from the National Transportation Safety Board will issue a preliminary report in the coming weeks, but a full report will likely take more than a year to complete to determine if the issue was pilot error, a defective component accident, or some other factor. This has been the case with other tragedies ranging from major Nevada motor vehicle accidents to gold mine accidents.

Those killed have been identified as two individuals from India, a couple from Kansas, and the Las Vegas pilot. The helicopter was en route from the Las Vegas airport to the Hoover Dam for a site-seeing trip operated by Sundance Helicopters. The company is building an infamous reputation for itself with a variety of documented safety issues over several years including a 2003 Nevada helicopter crash that killed seven. In addition to Las Vegas personal injury liability borne by the company from survivors of crashes, the company is now likely to face Nevada wrongful death lawsuits if reports find that it hired an unqualified pilot or failed to appropriately maintain its aircraft. If you or a loved one need legal guidance from an experienced Las Vegas personal injury attorney, contact us today for a free consultation.

December 14th, 2011 No comments

Today, a New York woman was killed in an extremely rare elevator accident The 41-year old advertising executive, whose shoe was caught in the gap, was crushed when the people mover, doors still open, rose unexpectedly. Two people in the elevator were taken to local hospitals for observation, due to the witnessing the horrific event. While all elevators are inspected frequently, injuries and deaths are often due to negligence. Thousands of people ride elevators in Las Vegas and while injuries are rare, other Nevada casino injuries happen daily.

In Nevada hotels, casinos and offices, people can suffer a litany of injuries. Serving alcohol also increases the risk of injury – either by assault or from slips and falls. These injuries are not limited to Nevada tourist injuries, however. In this charged environment, employees can also suffer Clark County workplace injuries and need support for workers compensation and health care claims.

If you or someone you know has been injured in an elevator or workplace, please document your injuries and receive medical help immediately. Please go to Bensonandbingham.com and contact us for representation. What often look like freak accidents are often due to negligence and our Nevada injury attorneys are poised to represent you.
