Vegas Black Friday shoppers beware…

As the overwhelming weight of the turkey and stuffing was just begin to fade, shoppers by the millions were heading out early to take advantage of the Black Friday deals offered by merchants all over Las Vegas and the country.  But despite the chorus of the most wonderful time of the year, Black Friday was for some Las Vegas residents a time to be concerned about an injury.  In Los Angeles a women apparently used pepper spray to move people away from a crate of X-box games being unwrapped in a Wal-Mart.

There should never be a reason in Nevada to take the chance of injuring a fellow citizen over the prospect of a present no matter how much one might want it, but today one runs the risk of a personal injury in Las Vegas while shopping.  Thankfully it seems that the people who were sprayed did not suffer serious injury, there exists little doubt that serious injuries are possible.  In the worst case scenario people can killed by people in a shopping situation.  In another California city a man was shot on Black Friday when he refused to give his new found gifts to a robber outside a store.  The man thankfully did not die but is in serious condition.

Las Vegas families at risk of E. coli poisoning from defective products

Frequent readers of our Las Vegas injury and accident blog are no strangers to our coverage of Nevada product liability laws and the tragic incidents that make these laws so important. Usually these stories have something to do with an unsafe child car seat, a malfunctioning or poorly designed child’s toy, or a Nevada automobile recall. But a recent threat to public safety has taken a less common form.

Some 5,500 bags of Ready Pac brand vegetable products are being recalled as part of a voluntary recall targeting possible E. coli contamination. The pre-packed salad mixes and other products were distributed across the western United States including in our state, which may give rise to injuries requiring the work of a Las Vegas food poisoning lawyer. Although the recall is voluntary, these recalls do not indicate that the risk of Nevada personal injuries are any less severe. Rather, companies often recall products voluntarily in a bid to avoid public shame, paranoia, and to provide affected consumers with a safe replacement product so as to not compromise loyalty.

Recent violent incidents cause devastating Nevada personal injuries, wrongful deaths

If the late summer and early fall were not harrowing enough months for the Silver State, a new raft of problems has beset our communities to ensure that the winter kicks off with appropriate gloom. Two recent incidents — one apparently a Nevada intentional injury case and the other a tragically preventable accident — drive home the point that life-changing incidents are sometimes just around the bend.

Northern Nevada residents are still mourning the loss of a local television news sports anchor who was killed over the weekend. While leaving the football stadium following a University of Nevada, Reno victory over Hawai’i, the sports anchor was reportedly struck by a vehicle in what is now being treated as a Nevada hit-and-run DUI accident. The circumstances could not have been more tragic — a few moments of distraction, facilitated by an irresponsible choice to drink and drive, has irrevocably taken a loving husband and father of three from a family and a beloved television personality from a community audience. It is never possible to put a price on such a loss, but Nevada wrongful death law is intended to give affected families a way to quantify their losses and gain compensation.

The other incident that has clouded headlines and left heads shaking is the apparently intentional Nevada shooting injury that ultimately claimed the victim’s life. Apparently two men were driving west into Reno in northern Nevada when they became angry with one another due to driving aggression. Both vehicles pulled off at a freeway exit and one man allegedly pulled out a gun and shot the other driver. Two weeks after the Halloween-night shooting, the victim has succumbed to his injuries and died. With the state’s marquee activities slipping, will Nevada personal injuries also fall?

A new report out this week shines a dim light on Nevada’s marquee industry of entertainment gambling. Although aggregate gaming revenues increased some eight percent over last year in the rural community of Elko and revenues were up slightly in the Reno area, the Las Vegas region saw revenues fall by 5.7 percent and state revenues overall were down nearly six percent. As the languishing economy continues to undermine this major part of the state’s economy, might a benefit be a decline in Nevada personal injuries?

This suggestion may seem silly, but we have to analyze it in the context of the state’s larger economic activities. Although Nevada saw record growth for nearly two decades, the bursting of the housing bubble left thousands of Nevada construction workers out of work. “Secret list” of polluters reveals risk of Nevada chemical poisoning

After a combined effort by National Public Radio and the Center for Public Integrity, headlines this week are exploding with discussion of some 1,600 chronic polluters who have been allowed to continue operating in violation of clean air and clean water standards, even under regulatory eyes.  The damning output of this investigative report suggests not only corporate ambivalence to potential Nevada chemical poisoning but also underwhelming government oversight.

The report in question is the result of extensive analysis of the Environmental Protection Agency’s own internal data on polluters, and it finds that these hundreds and hundreds of sites were home to chronic environmental threats deserving of “urgent” action, even though some 300 of the sites had remained with this same designation for decades. Many of the standards and reporting mechanisms at play were created more than 20 years ago with the federal Clean Air Act amendments. State-level agencies are responsible for collaborating — albeit in various ways — with federal regulators to ensure ground-level compliance. But as this report finds, widespread Nevada public agency negligence may have allowed operators such as Barrick Gold to pollute with impunity.
